   McDONALD -- read once and referred to the Committee  on  Corporations,
   Authorities and Commissions
 
 AN  ACT  to  amend  the public authorities law, in relation to providing
   discounted congestion charge rates for certain transportation  network
   company vehicles

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public authorities law  is  amended  by  adding  a  new
 section 2858 to read as follows:
   §  2858.  DISCOUNTED  RATES FOR CERTAIN TRANSPORTATION NETWORK COMPANY
 VEHICLES.  1. NOTWITHSTANDING THE PROVISIONS OF ANY LAW TO THE CONTRARY,
 IF ANY AUTHORITY SHALL IMPLEMENT ANY TOLLS, FARES, FEES OR OTHER CHARGES
 FOR THE PURPOSE OF RAISING REVENUES FOR  PUBLIC  TRANSIT  SYSTEMS,  SUCH
 TOLLS,  FARES,  FEES  OR OTHER CHARGES SHALL BE REDUCED BY THE FOLLOWING
 AMOUNTS FOR THE FOLLOWING TYPES OF VEHICLES FOR  TRANSPORTATION  NETWORK
 COMPANIES:
   A.  FOR  AN  ELECTRIC  OR  HYDROGEN FUEL CELL VEHICLE THE RATE OF SUCH
 TOLLS, FARES, FEES OR OTHER CHARGES SHALL BE ONE-HALF OF THE RATE ESTAB-
 LISHED TO RAISE REVENUE; AND
   B. FOR A HYBRID ELECTRIC VEHICLE THE RATE OF SUCH TOLLS,  FARES,  FEES
 OR OTHER CHARGES SHALL BE THREE-FOURTHS OF THE RATE ESTABLISHED TO RAISE
 REVENUE.
   2. FOR THE PURPOSES OF THIS SECTION THE FOLLOWING TERMS SHALL HAVE THE
 FOLLOWING MEANINGS:
   A.  THE  TERM  "ELECTRIC OR HYDROGEN FUEL CELL VEHICLE" SHALL MEAN AND
 INCLUDE A MOTOR VEHICLE THAT:
   (I) HAS FOUR WHEELS;
   (II) WAS MANUFACTURED FOR USE PRIMARILY ON PUBLIC STREETS,  ROADS  AND
 HIGHWAYS;
   (III)  THE POWERTRAIN OF WHICH HAS NOT BEEN MODIFIED FROM THE ORIGINAL
 MANUFACTURER'S SPECIFICATIONS;
   (IV) IS RATED AT NOT MORE THAN  EIGHT  THOUSAND  FIVE  HUNDRED  POUNDS
 GROSS VEHICLE WEIGHT;
