 AN ACT to amend the education law, in relation to requiring training for
   teachers and administrators in the area of childhood trauma
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 3004 of the education law is amended  by  adding  a
 new subdivision 4-a to read as follows:
   4-A.    IN RECOGNIZING THE EFFECTS OF TRAUMA ON THE CHILD DEVELOPMENT,
 THE COMMISSIONER SHALL PRESCRIBE REGULATIONS REQUIRING THAT ALL  PERSONS
 APPLYING ON OR AFTER JANUARY FIRST, TWO THOUSAND NINETEEN FOR A TEACHING
 CERTIFICATE  OR  LICENSE AS A SPECIAL EDUCATION TEACHER FOR THE PURPOSES
 PURSUANT TO ARTICLE EIGHTY-NINE OF THIS CHAPTER SHALL,  IN  ADDITION  TO
 ALL  THE  OTHER  CERTIFICATION OR LICENSING REQUIREMENTS, HAVE COMPLETED
 ENHANCED COURSE WORK OR TRAINING IN THE AREA OF TRAUMA AS IT RELATES  TO
 CHILDREN  AND ITS IMPACT ON CHILD DEVELOPMENT AND LEARNING. IN ADDITION,
 SUCH REGULATIONS SHALL REQUIRE THAT ENHANCED TRAINING IN  THE  NEEDS  OF
 CHILDREN  WHO  HAVE  EXPERIENCED  TRAUMA  BE  PROVIDED TO EACH CERTIFIED
 SCHOOL ADMINISTRATOR OR SUPERVISOR ASSIGNED ON OR AFTER  JANUARY  FIRST,
 TWO  THOUSAND  NINETEEN  TO  SERVE AS A SCHOOL ADMINISTRATOR INCLUDING A
 SPECIAL EDUCATION ADMINISTRATOR.  SUCH TRAINING SHALL BE PROVIDED  PRIOR
 TO, OR AS SOON AS PRACTICABLE FOLLOWING, ASSIGNMENT AS A SCHOOL ADMINIS-
 TRATOR OR SPECIAL EDUCATION ADMINISTRATOR. INDIVIDUALS SERVING AS SCHOOL
 ADMINISTRATORS  OR SPECIAL EDUCATION ADMINISTRATORS AS OF JANUARY FIRST,
 TWO THOUSAND NINETEEN SHALL COMPLETE SUCH TRAINING  BY  SUCH  DATE.  THE
 ENHANCED  COURSE  WORK OR TRAINING SHALL BE OBTAINED FROM AN INSTITUTION
 OR PROVIDER WHICH HAS BEEN APPROVED BY THE DEPARTMENT  TO  PROVIDE  SUCH
 COURSE WORK OR TRAINING IN THE NEEDS OF THOSE WHO HAVE EXPERIENCED TRAU-
 MA,  PROVIDED THAT ENHANCED TRAINING FOR CERTIFIED SCHOOL ADMINISTRATORS
 OR SUPERVISORS THAT MEETS STANDARDS PRESCRIBED BY THE  COMMISSIONER  MAY
 BE  INCLUDED  IN  THE  PROFESSIONAL  DEVELOPMENT  PROVIDED BY THE SCHOOL
 DISTRICT OR BOARD OF COOPERATIVE EDUCATIONAL SERVICES TO  SUCH  ADMINIS-
 TRATORS OR SUPERVISORS.
   § 2. This act shall take effect immediately.

 AN  ACT  to  amend  the  education  law,  in relation to authorizing and
   directing the commissioner of education to  conduct  a  study  on  the
   effects of trauma on child development and learning
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 305 of the education law is amended by adding a new
 subdivision 59 to read as follows:
   59. A. THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO CONDUCT A  STUDY
 ON  THE  EFFECTS OF TRAUMA ON CHILD DEVELOPMENT AND LEARNING. SUCH STUDY
 SHALL INCLUDE, BUT NOT BE LIMITED TO, THE FOLLOWING:
   (I) THE TYPES OF TRAUMA EXPERIENCED BY STUDENTS;
   (II) THE IMPACTS OF TRAUMA ON CHILD DEVELOPMENT AND LEARNING;
   (III) SCREENING AND ASSESSMENTS OF TRAUMA AVAILABLE IN SCHOOLS;
   (IV) PROGRAMS, INTERVENTIONS, AND SERVICES RELATED TO TRAUMA THAT  ARE
 AVAILABLE IN SCHOOLS; AND
   (V)  BEST  PRACTICES  FOR SCHOOL PERSONNEL IN THE AREA OF TRAUMA AS IT
 RELATES TO CHILD DEVELOPMENT AND LEARNING.
   B. WITHIN ONE YEAR OF THE EFFECTIVE  DATE  OF  THIS  SUBDIVISION,  THE
 COMMISSIONER  SHALL  DELIVER  A REPORT OF THE FINDINGS OF SUCH STUDY AND
 RECOMMENDATIONS BASED ON SUCH FINDINGS TO THE  GOVERNOR,  THE  TEMPORARY
 PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE MINORITY LEAD-
 ER  OF  THE  SENATE AND THE MINORITY LEADER OF THE ASSEMBLY. SUCH REPORT
 SHALL ALSO INCLUDE SUCH LEGISLATIVE PROPOSALS AS THE COMMISSIONER  DEEMS
 NECESSARY TO IMPLEMENT HIS OR HER RECOMMENDATIONS.
   § 2. This act shall take effect immediately.
