Requires mandatory continuing education for cosmetologists and barbers; provides that during each four year license renewal period cosmetologists and barbers shall complete 36 hours of acceptable formal continuing education and shall be issued a certificate of completion to be submitted with their application for renewal of their cosmetology and/or barbering license.

 AN ACT to amend the general  business  law,  in  relation  to  requiring
   continuing education for the practice of cosmetology and barbering
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law  is  amended  by  adding  two  new
 sections 401-a and 432-a to read as follows:
   §   401-A.  MANDATORY  CONTINUING  EDUCATION.  1.  EACH  COSMETOLOGIST
 LICENSED UNDER THIS ARTICLE SHALL COMPLY  WITH  THE  PROVISIONS  OF  THE
 MANDATORY  CONTINUING  EDUCATION  REQUIREMENTS PRESCRIBED IN SUBDIVISION
 TWO OF THIS SECTION.  COSMETOLOGISTS WHO DO NOT  SATISFY  THE  MANDATORY
 CONTINUING  EDUCATION  REQUIREMENTS SHALL NOT PRACTICE COSMETOLOGY OR BE
 ISSUED A RENEWED LICENSE UNDER THIS ARTICLE.
   2. DURING EACH FOUR YEAR LICENSE RENEWAL PERIOD A COSMETOLOGIST  SHALL
 COMPLETE  THIRTY-SIX  HOURS  OF  ACCEPTABLE FORMAL CONTINUING EDUCATION.
 FOUR OF SUCH CONTINUING EDUCATION HOURS SHALL INCLUDE TRAINING ON RECOG-
 NIZING SIGNS OF DOMESTIC ABUSE AND/OR HUMAN TRAFFICKING.
   3. CONTINUING EDUCATION HOURS TAKEN DURING ONE LICENSE RENEWAL  PERIOD
 SHALL  NOT  BE  CARRIED  OVER  OR  OTHERWISE TRANSFERRED TO A SUBSEQUENT
 LICENSE RENEWAL PERIOD.
   4. AS USED IN THIS SECTION, "ACCEPTABLE FORMAL  CONTINUING  EDUCATION"
 SHALL  MEAN FORMAL PROGRAMS OF LEARNING PROVIDED BY AN ACCREDITED COSME-
 TOLOGY  SCHOOL  OR  BY  MANUFACTURERS  OR  DISTRIBUTORS  OF  COSMETOLOGY
 PRODUCTS. SUCH CONTINUING EDUCATION MAY INCLUDE, BUT SHALL NOT BE LIMIT-
 ED  TO,  SPECIALTY COLOR SERVICES, SCISSOR AND RAZOR CUTTING TECHNIQUES,
 AND COSMETOLOGY PRODUCT KNOWLEDGE.   SUCH CONTINUING  EDUCATION  MAY  BE
 CONDUCTED THROUGH AN ONLINE COURSE.
   5.  WHEN A COSMETOLOGIST LICENSED UNDER THIS ARTICLE HAS FULFILLED THE
 MANDATORY CONTINUING EDUCATION REQUIREMENTS PURSUANT TO SUBDIVISION  TWO
 OF  THIS  SECTION,  SUCH  COSMETOLOGIST SHALL BE ISSUED A CERTIFICATE OF
 COMPLETION. A CERTIFICATE OF COMPLETION SHALL BE  SUBMITTED  WITH  EVERY
 APPLICATION  FOR  RENEWAL  OF  A  COSMETOLOGY LICENSE.   NO RENEWAL OF A
