S T A T E O F N E W Y O R K ________________________________________________________________________ 11021 I N A S S E M B L Y May 31, 2018 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Stern) -- read once and referred to the Committee on Transportation AN ACT to authorize the state commissioner of transportation to convey real property to the town of Huntington, county of Suffolk THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state commissioner of transportation is authorized and empowered to transfer and convey certain state property, as further described in section two of this act, to the town of Huntington, Suffolk county, for fair market value, upon such terms and conditions as such commissioner may fix and determine including, but not limited to, preserving one hundred percent of existing parking in a suitable location in consultation with the Metropolitan Transportation Authority and reserving those portions of the property necessary for existing and future highway needs. § 2. The lands authorized by this act to be conveyed consists of one parcel of land in the town of Huntington, Suffolk county, and is gener- ally described as follows: Parcel 0400-147.00-01.00-003.000, a 181,029 square foot parcel (approximately 4.2 acres) adjacent to New York Avenue/state route 110 and bordered to the north by Church Street, to the east by New York Avenue, to the south by the Long Island Rail Road right of way and to the west by multiple parcels. The parcel is bisected by Railroad Street. § 3. The description in section two of this act of the lands to be conveyed is not intended to be a legal description, but is intended only to identify the premises to be conveyed. As a condition of purchase the town of Huntington shall submit to the state commissioner of transporta- tion for said commissioner's approval an accurate survey and description of the lands generally described in section two of this act, which may be used in the conveyance thereof. § 4. The state commissioner of transportation shall not grant the land description in section two of this act unless application is made there- for by the town of Huntington within five years after the effective date EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
