 AN  ACT  to  amend  the real property law, in relation to the duties and
   responsibilities of manufactured home park owners and  residents,  the
   sale  of  manufactured home parks; and to amend the executive law, the
   real property law, the vehicle and traffic law and the estates, powers
   and trusts law, in relation to the conveyance and encumbrance of manu-
   factured homes as real property
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  This act shall be known and may be cited as the "New York
 Manufactured Home Modernization Act".
   § 2. Subdivision a of section 233 of the real property law, as amended
 by chapter 566 of the laws of 1996, is amended to read as follows:
   a. Wherever used in this section:
   1. The term "manufactured home tenant" means one who rents space in  a
 manufactured  home  park from a manufactured home park owner or operator
 for the purpose of parking his manufactured home or  [one  who  rents  a
 manufactured  home  in a manufactured home park from a manufactured home
 park owner or operator] A MANUFACTURED HOME RENTER AS  DEFINED  IN  THIS
 SUBDIVISION.
   2.  THE TERM "MANUFACTURED HOME RENTER" MEANS ONE WHO RENTS A MANUFAC-
 TURED HOME IN A MANUFACTURED HOME PARK FROM  A  MANUFACTURED  HOME  PARK
 OWNER  OR OPERATOR OR FROM AN ENTITY IN WHICH THE MANUFACTURED HOME PARK
 OWNER OR OPERATOR OWNS AN INTEREST.
   3. The term "manufactured home owner"means one who holds  title  to  a
 manufactured home.
   [3.] 4. The term "manufactured home park" means a contiguous parcel of
 privately owned land which is used for the accommodation of [three] FIVE
 or more manufactured homes occupied for year-round living.
   5.  THE TERM "MANUFACTURED HOME PARK OWNER" MEANS ANY PERSON OR ENTITY
 OWNING AN INTEREST IN THE LAND OF A MANUFACTURED HOME PARK.
