S T A T E O F N E W Y O R K ________________________________________________________________________ 11343 I N A S S E M B L Y September 19, 2018 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Ortiz) -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to permitting additional persons to provide notification to the board of elections in the case of the death of a registered voter THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 5-400 of the election law is amended by adding a new subdivision 3 to read as follows: 3. IF A VOTER DIES, STATE AND COUNTY BOARDS OF ELECTIONS SHALL PERMIT THE NEXT OF KIN OR ATTORNEY IN FACT FOR SUCH VOTER TO FILL OUT ANY NECESSARY CERTIFICATE OF DEATH FORMS OR DOCUMENTS FOR PROPER REMOVAL OF SUCH DECEASED VOTER FROM VOTER ROLLS PURSUANT TO PARAGRAPH (E) OF SUBDI- VISION ONE OF THIS SECTION. IF SUCH DECEASED VOTER HAS NO NEXT OF KIN OR POWERS OF ATTORNEY, HOSPITAL ADMINISTRATORS AND FUNERAL DIRECTORS SHALL ALSO BE PERMITTED TO PROVIDE THE BOARD OF ELECTIONS WITH SUCH FORMS OR DOCUMENTS NECESSARY FOR THE REMOVAL OF SUCH DECEASED VOTER FROM VOTER ROLLS. § 2.
