Relates to standards of payment for foster care; requires the office of children and family services to include, and the division of budget to approve, an increase for salaries equal to the higher of the three year average in the personal income growth index in each year's Maximum State Aid Rate or the Cost-of-Living Adjustments included in contracts for state employees.

 AN  ACT  to  amend  the social services law, in relation to standards of
   payment for foster care
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  398-a  of  the social services law is amended by
 adding a new subdivision 6 to read as follows:
   (6) NOTWITHSTANDING ANY PROVISIONS OF THIS SECTION  TO  THE  CONTRARY,
 THE  OFFICE OF CHILDREN AND FAMILY SERVICES SHALL INCLUDE, AND THE DIVI-
 SION OF BUDGET SHALL APPROVE, AN INCREASE  FOR  SALARIES  EQUAL  TO  THE
 HIGHER  OF THE THREE YEAR AVERAGE IN THE PERSONAL INCOME GROWTH INDEX IN
 EACH YEAR'S MAXIMUM STATE  AID  RATE  ("MSARS")  OR  THE  COST-OF-LIVING
 ADJUSTMENTS  ("COLAS")  INCLUDED IN CONTRACTS FOR STATE EMPLOYEES.  NON-
 PERSONAL COSTS AND FRINGE BENEFITS SHALL BE  TRENDED  AT  LEAST  BY  THE
 APPROPRIATE  APPLICATIONS  OF  THE CONSUMER PRICE INDEX FOR THE STATE OF
 NEW YORK.
   § 2. This act shall take effect immediately.
