 AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
   relation to permitting drug-free adhesive breathing devices
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.   The racing, pari-mutuel  wagering  and  breeding  law  is
 amended by adding a new section 218-a to read as follows:
   §  218-A. EQUIPMENT REGULATED. ONLY EQUIPMENT SPECIFICALLY APPROVED BY
 THE STEWARDS SHALL BE WORN OR CARRIED BY A JOCKEY OR A HORSE IN A  RACE;
 PROVIDED,  HOWEVER,  THE USE OF ANY DRUG-FREE ADHESIVE BREATHING DEVICE,
 CONSISTING OF A NON-IRRITATING ADHESIVE AND CONSTRUCTED OF UNITED STATES
 FOOD AND DRUG  ADMINISTRATION  APPROVED  MEDICAL-GRADE  COMPONENTS  THAT
 ASSISTS IN THE REDUCTION OF AIRWAY RESISTANCE WITHIN THE NASAL CAVITY OF
 A HORSE DURING ANY RACE MEETING SHALL NOT BE PROHIBITED.
   § 2. This act shall take effect immediately.
