 AN ACT to amend the vehicle and traffic law, in  relation  to  requiring
   the installation of partitions and shields on Westchester county omni-
   buses
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 375 of the vehicle and traffic law  is  amended  by
 adding a new subdivision 52 to read as follows:
   52.  WESTCHESTER  COUNTY OMNIBUS PARTITIONS AND SHIELDS. EVERY OMNIBUS
 SEATING TWENTY OR MORE  PASSENGERS  CURRENTLY  OPERATED  PURSUANT  TO  A
 CONTRACT  WITH  THE COUNTY OF WESTCHESTER FOR THE PROVISION OF REGULARLY
 SCHEDULED MASS TRANSPORTATION SERVICE TO THE PUBLIC  OVER  FIXED  ROUTES
 SHALL,  ON  OR BEFORE JUNE THIRTIETH, TWO THOUSAND EIGHTEEN, BE EQUIPPED
 WITH PARTITIONS OR SHIELDS MADE IN WHOLE OR IN  PART  OF  PLEXIGLASS  OR
 OTHER  SHATTERPROOF MATERIAL MEETING SPECIFICATIONS OF THE COMMISSION OF
 TRANSPORTATION, IN AN "L" SHAPED CONFIGURATION WHICH  EFFECTIVELY  SEPA-
 RATES  AND  SHIELDS  THE OPERATOR FROM THE PASSENGER COMPARTMENT OF SUCH
 OMNIBUS. IN THE CASE OF AN OMNIBUS OPERATING PRIOR TO ENACTMENT OF  THIS
 SUBDIVISION  BUT  EXPECTED  TO  BE  IN SERVICE AFTER JUNE THIRTIETH, TWO
 THOUSAND EIGHTEEN, THE OWNER OF SUCH  OMNIBUSES  SHALL  SUBMIT,  TO  THE
 COMMISSIONER  OF  TRANSPORTATION, A SCHEDULE OF THE ANNUAL RATE AT WHICH
 SUCH OMNIBUSES SHALL BE RETROFITTED TO COMPLY WITH THE  REQUIREMENTS  OF
 THIS  SUBDIVISION.  SUCH  SCHEDULE SHALL INCLUDE THE MOTOR VEHICLE IDEN-
 TIFICATION NUMBER OF EACH OMNIBUS SCHEDULED FOR RETROFIT IN A GIVEN YEAR
 AND SHALL, TO THE EXTENT POSSIBLE, PROVIDE FOR THE  COMPLETION  OF  SUCH
 RETROFITTING  IN EQUAL PROPORTIONS ANNUALLY. ANY SUCH OMNIBUSES ACQUIRED
 AFTER THE ENACTMENT OF THIS SUBDIVISION SHALL BE EQUIPPED WITH A  PARTI-
 TION OR SHIELD AS REQUIRED PURSUANT TO THIS SUBDIVISION.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law; provided, however, that effective immediate-
 ly,  the commissioner of transportation is authorized to promulgate such
 rules and regulations as he or she deems  necessary  to  effectuate  the
 provisions of this act on such date.
