DAVILA, GOODELL, MOSLEY -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to providing relief on statewide central register clearance fees for tax exempt organiza- tions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 1 of section 424-a of the social services law, as amended by section 1 of part R of chapter 58 of the laws of 2011, is amended to read as follows: (f) The office of children and family services shall charge a fee of twenty-five dollars when it conducts a search of its records within the statewide central register for child abuse or maltreatment in accordance with this section or regulations of the office to determine whether an applicant for employment is the subject of an indicated child abuse or maltreatment report including an applicant to be a child day care provider and a request made pursuant to subdivision six of this section. THE FEE OF TWENTY-FIVE DOLLARS SHALL NOT APPLY TO TAX-EXEMPT NOT-FOR- PROFIT CHILD CARE PROVIDERS REGISTERED AS A FEDERAL 501 C(3) CHARITABLE ORGANIZATION. Such fees shall be deposited in a special revenue - other account and shall be made available to the office for costs incurred in the implementation of this section. § 2.
