COOK, GLICK -- read once and referred to the Committee on Corpo- rations, Authorities and Commissions AN ACT to amend the public authorities law and the environmental conser- vation law, in relation to the construction of a pipeline property under the control of the New York state thruway authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 389 to read as follows: § 389. PIPELINE LIMITATION. NOTWITHSTANDING THE PROVISIONS OF SUBDIVI- SION ELEVEN OF SECTION THREE HUNDRED FIFTY-FOUR OF THIS TITLE OR ANY OTHER LAW, RULE OR REGULATION TO THE CONTRARY, THE AUTHORITY SHALL NOT CONSTRUCT OR MAINTAIN OR ENTER INTO ANY LEASE OR CONTRACT FOR THE CONSTRUCTION OR MAINTENANCE OF OR GRANT ANY PERMIT OR EASEMENT IN CONNECTION WITH THE CONSTRUCTION OF A PIPELINE DESIGNED TO CARRY HAZARD- OUS SUBSTANCES OR PETROLEUM, ON PROPERTY UNDER THE CONTROL OF THE AUTHORITY. § 2. The environmental conservation law is amended by adding a new section 3-321 to read as follows: § 3-321. PIPELINE LIMITATION. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, THE DEPARTMENT SHALL NOT APPROVE ANY APPLICATION FOR ANY PERMIT, CERTIF- ICATION OR AUTHORIZATION IN CONNECTION WITH THE CONSTRUCTION OF A PIPE- LINE DESIGNED TO CARRY HAZARDOUS SUBSTANCES OR PETROLEUM, ON PROPERTY UNDER THE CONTROL OF THE NEW YORK STATE THRUWAY AUTHORITY. § 3.
