GUNTHER -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to authorizing blood transfusions without a nurse under certain circumstances THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 3121 of the public health law, as added by chapter 914 of the laws of 1973, is amended to read as follows: 5. The council shall have power by the affirmative vote of a majority of its members to enact, and from time to time, amend and repeal, rules and regulations establishing minimum standards for the proper collection, processing, fractionation, storage, distribution, and supply of human blood or blood derivatives, for the purpose of transfusions, subject to approval by the commissioner. SUCH REGULATIONS SHALL ALLOW FOR ADVANCED EMERGENCY MEDICAL TECHNICIANS TO ADMINISTER BLOOD TRANS- FUSIONS WITHOUT THE PRESENCE OF A PHYSICIAN, REGISTERED NURSE, PHYSICIAN ASSISTANT, NURSE PRACTITIONER, LICENSED PRACTICAL NURSE, OR BOARD-CERTI- FIED CARDIOVASCULAR PERFUSIONIST ON AN EMERGENCY BASIS DURING THE TRANS- PORT TO THE HOSPITAL. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the council on human blood and transfusion services may promulgate any rule or regulation necessary for timely implementation of this act on its effective date.
