AN ACT to amend the alcoholic beverage control law, in relation to
allowing licenses to sell liquor at retail for consumption off prem-
ises for real property owned or controlled by the state
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 63 of the alcoholic beverage control law is amended
by adding a new subdivision 7 to read as follows:
7. FOR ANY PREMISES LOCATED ON REAL PROPERTY OWNED OR CONTROLLED BY
THE STATE OF NEW YORK, ANY POLITICAL SUBDIVISION THEREOF, OR ANY
BI-STATE AGENCY OF WHICH THE STATE OF NEW YORK IS A PARTY, AND WHERE
SUCH PROPERTY IS LOCATED WITHIN OR ON ANY AIRPORT, RAILROAD STATION,
LODGING FACILITY OR, IN THE DISCRETION OF THE AUTHORITY, ANY OTHER SUCH
SIMILAR PROPERTY OR FACILITY SO OWNED OR CONTROLLED BY THE STATE OF NEW
YORK, ANY POLITICAL SUBDIVISION THEREOF, OR ANY BI-STATE AGENCY OF WHICH
THE STATE OF NEW YORK IS A PARTY, SUBDIVISIONS FOUR AND FIVE OF THIS
SECTION SHALL NOT APPLY AND THAT THE LICENSE PRIVILEGE SHALL INCLUDE THE
SALE OF MALT BEVERAGES AND CIDER, PROVIDED THAT ALL ALCOHOLIC BEVERAGE
PRODUCTS BEING SOLD AT SUCH PREMISES ARE NEW YORK LABELED WINE, LIQUOR,
BEER AND CIDER AS DEFINED BY SECTION THREE OF THIS CHAPTER.
§ 2. Subdivision 2 of section 105 of the alcoholic beverage control
law, as amended by chapter 536 of the laws of 1966, is amended to read
as follows:
2. No premises shall be licensed to sell liquors and/or wines at
retail for off premises consumption, unless said premises shall be
located in a store, the principal entrance to which shall be from the
street level and located on a public thoroughfare in premises which may
be occupied, operated or conducted for business, trade or industry or on
an arcade or sub-surface thoroughfare leading to a railroad terminal.
There may be not more than one additional entrance which shall be from

the street level and located on and giving access to and from a public
or private parking lot or parking area having space for not less than
five automobiles. THIS SUBDIVISION SHALL NOT APPLY TO PREMISES LICENSED
PURSUANT TO SUBDIVISION SEVEN OF SECTION SIXTY-THREE OF THIS CHAPTER.
§ 3. This act shall take effect immediately.
