 AN ACT to amend the social services law, in relation to limiting co-pay-
   ments for child care subsidies

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subdivision 6 of section 410-x of the social services law,
 as added by section 52 of part B of chapter 436 of the laws of 1997,  is
 amended to read as follows:
   6.  Pursuant to department regulations, child care assistance shall be
 provided on a sliding fee basis based upon the family's ability to  pay.
 NO  CO-PAYMENT SHALL BE ASSESSED TO A FAMILY WHOSE INCOME IS AT OR BELOW
 THE STATE INCOME STANDARD AS DEFINED IN SUBDIVISION TWO OF SECTION  FOUR
 HUNDRED TEN-W OF THIS TITLE. CO-PAYMENTS SHALL NOT EXCEED TEN PERCENT OF
 THE HOUSEHOLD INCOME.
   §  2. This act shall take effect on the first of January next succeed-
 ing the date on which it shall have become a law.
