 AN ACT to amend the penal law, in relation to  creating  an  affirmative
   defense to prostitution
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The penal law is amended by adding a new section 230.09  to
 read as follows:
 § 230.09 PROSTITUTION; DEFENSE.
   IN ANY PROSECUTION UNDER SECTION 230.00 OF THIS ARTICLE OR SUBDIVISION
 TWO  OF  SECTION  240.37 OF THIS PART, IT IS AN AFFIRMATIVE DEFENSE THAT
 THE DEFENDANT'S PARTICIPATION IN THE OFFENSE WAS A  RESULT  OF  BEING  A
 VICTIM  OF  SEX  TRAFFICKING  UNDER  SECTION 230.34 OF THIS ARTICLE OR A
 VICTIM  OF  TRAFFICKING  IN  PERSONS  UNDER  THE   TRAFFICKING   VICTIMS
 PROTECTION ACT (UNITED STATES CODE, TITLE 22, CHAPTER 78).
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
