S T A T E O F N E W Y O R K ________________________________________________________________________ 5173 2017-2018 Regular Sessions I N A S S E M B L Y February 6, 2017 ___________ Introduced by M. of A. SKARTADOS -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to permitting teachers to record classroom lessons and retain rights THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3037 to read as follows: § 3037. TEACHERS RETAINING RIGHTS TO RECORDED LESSONS. 1. A TEACHER MAY, WITH EITHER WRITTEN PERMISSION FROM THE PARENTS OF THOSE STUDENTS INVOLVED OR BY REMOVING ANY WAY TO IDENTIFY A STUDENT VIA FACE BLURRING, RECORD CLASSROOM LESSONS BEING GIVEN BY THE TEACHER. A TEACHER IS NOT REQUIRED TO RECEIVE PERMISSION FROM THE SCHOOL TO RECORD A LESSON AND A SCHOOL SHALL NOT ENACT POLICIES TO PREVENT SUCH RECORDINGS FROM OCCUR- RING. 2. THE COPYRIGHT TO ANY RECORDED LESSONS IS HELD SOLELY BY THE TEACHER OR TEACHERS WHO MADE THE RECORDING. § 2. This act shall take effect immediately.
