OAKS -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to granting a waiver of the photo image fee charged for the processing of certain license documents to veterans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 2 of section 503 of the vehi- cle and traffic law, as amended by section 2 of part F of chapter 59 of the laws of 2009, is amended to read as follows: (f) Photo image fee. (I) In addition to any other fee prescribed here- in, a fee of twelve dollars and fifty cents shall be charged for the processing of each learner permit or license document requiring a photo image. Of each such fee collected, five dollars shall be deposited to the credit of the general fund and five dollars shall be deposited in the dedicated highway and bridge trust fund established pursuant to section eighty-nine-b of the state finance law and the dedicated mass transportation TRUST fund established pursuant to section eighty-nine-c of the state finance law and distributed according to the provisions of subdivision (d) of section three hundred one-j of the tax law. (II) Notwithstanding any inconsistent provision of this section, the difference collected between the fees set forth in this paragraph in effect on and after September first, two thousand nine and the fees set forth in this paragraph in effect prior to such date shall be deposited to the credit of the dedicated highway and bridge trust fund. (III) NOTWITHSTANDING ANY INCONSISTENT PROVISION OF THIS SECTION, THE PHOTO IMAGE FEE SET FORTH IN THIS PARAGRAPH SHALL NOT BE CHARGED FOR THE PROCESSING OF THE REPLACEMENT OF A LICENSE DOCUMENT WHICH DOES NOT INCLUDE THE VETERAN DESIGNATION FOR A DOCUMENT WHICH INCLUDES THE VETER- AN STATUS DESIGNATION PURSUANT TO PARAGRAPH (A-ONE) OF SUBDIVISION ONE OF SECTION FIVE HUNDRED FOUR OF THIS ARTICLE. THIS SUBPARAGRAPH SHALL NOT APPLY TO REGULAR RENEWALS. § 2. This act shall take effect immediately.
