DILAN, PEOPLES-STOKES -- (at request of the Divi- sion of Human Rights) -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to clarifying that reasonable accommodation to enable a person with a disability to use and enjoy a dwelling includes the use of an animal to alleviate the symptoms or effects of a disability THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 2 of paragraph (d) of subdivision 2-a of section 296 of the executive law, as amended by chapter 196 of the laws of 2010, is amended to read as follows: (2) To refuse to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford a person with a disability equal opportunity to use and enjoy a dwelling, INCLUDING THE USE OF AN ANIMAL AS A REASONABLE ACCOMMODATION TO ALLEVIATE SYMPTOMS OR EFFECTS OF A DISABILITY, AND including reason- able modification to common use portions of the dwelling, or § 2. Paragraph 2 of subdivision 18 of section 296 of the executive law, as amended by chapter 196 of the laws of 2010, is amended to read as follows: (2) To refuse to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford said person with a disability equal opportunity to use and enjoy a dwelling, INCLUDING THE USE OF AN ANIMAL AS A REASONABLE ACCOMMODATION TO ALLEVIATE SYMPTOMS OR EFFECTS OF A DISABILITY, AND including reason- able modification to common use portions of the dwelling, or § 3.
