AN ACT to amend the mental hygiene law, in relation to establishing  the
  care  demonstration  program;  and  providing  for  the repeal of such
  provisions upon expiration thereof

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  13.09  of  the  mental hygiene law is amended by
adding a new subdivision (i) to read as follows:
  (I)(1)  THE  COMMISSIONER  SHALL  ESTABLISH  THE  CARE   DEMONSTRATION
PROGRAM,  TO UTILIZE THE STATE WORKFORCE TO PROVIDE COMMUNITY BASED CARE
TO INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES. THE SERVICES PROVIDED BY
THIS PILOT PROGRAM SHALL INCLUDE, BUT SHALL NOT BE LIMITED TO  COMMUNITY
HABILITATION, IN-HOME RESPITE, PATHWAYS TO EMPLOYMENT, SUPPORTED EMPLOY-
MENT (SEMP), AND COMMUNITY PREVOCATIONAL SERVICES.
  (2)  THE  OFFICE  SHALL  MONITOR  THE QUALITY AND EFFECTIVENESS OF THE
DEMONSTRATION PROGRAM, AND SHALL REPORT SUCH RESULTS  TO  THE  GOVERNOR,
THE  TEMPORARY PRESIDENT OF THE SENATE, AND THE SPEAKER OF THE ASSEMBLY,
NO LATER THAN DECEMBER THIRTY-FIRST, TWO THOUSAND TWENTY.
  (3) THE COMMISSIONER SHALL PROMULGATE ALL RULES AND REGULATIONS NECES-
SARY TO IMPLEMENT THE PROVISIONS OF THIS SUBDIVISION.
  § 2. This act shall take effect immediately and shall  expire  and  be
deemed  repealed  March  31,  2020; provided however, that all rules and
regulations necessary for the implementation of this act shall have been
promulgated prior to such effective date.

  tee on Mental Health -- committee discharged,  bill  amended,  ordered
  reprinted as amended and recommitted to said committee

AN  ACT to require the office for people with developmental disabilities
  to establish the care demonstration program; to monitor and report  on
  the  effectiveness  thereof;  and to repeal certain provisions of such
  law relating thereto

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. (a) The commissioner of the office for people with develop-
mental  disabilities  shall establish the care demonstration program, to
utilize the state workforce to provide community based care to  individ-
uals with developmental disabilities.
  (b) The services provided by these pilots shall include, but shall not
be limited to:
  (i) community habilitation;
  (ii) in-home respite;
  (iii) pathways to employment;
  (iv) supported employment (SEMP); and
  (v) community prevocational services.
  § 2. The office for people with developmental disabilities shall moni-
tor  the  quality  and  effectiveness of the demonstration programs, and
shall report such results to the governor, the  temporary  president  of
the  senate, and the speaker of the assembly, no later than December 31,
2020.
  § 3. The commissioner of the office for people with disabilities shall
promulgate  all  rules  and  regulations  necessary  to  implement   the
provisions of this section.
  §  4.  This  act shall take effect immediately and shall expire and be
deemed repealed March 31, 2021; provided however,  that  all  rules  and
