S T A T E O F N E W Y O R K ________________________________________________________________________ 7643 2017-2018 Regular Sessions I N A S S E M B L Y May 5, 2017 ___________ Introduced by M. of A. WALLACE -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to the creation and disbursement of addiction treatment educational materials THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3309-b to read as follows: § 3309-B. ADDICTION TREATMENT EDUCATIONAL MATERIALS. 1. THE COMMIS- SIONER SHALL CREATE AND/OR UTILIZE EXISTING EDUCATIONAL MATERIALS REGARDING ADDICTION TREATMENT AND TREATMENT RESOURCES THAT ARE AVAILABLE THROUGH THE DEPARTMENT. SUCH EDUCATIONAL MATERIALS MAY INCLUDE, BUT SHALL NOT BE LIMITED TO, PAMPHLETS, LEAFLETS AND BROCHURES. 2. THE DEPARTMENT SHALL MAKE SUCH EDUCATIONAL MATERIALS AVAILABLE TO ALL HOSPITALS AND PHYSICIANS WITHIN THE STATE. 3. EVERY HOSPITAL AND PHYSICIAN SHALL THEN DISTRIBUTE THE EDUCATIONAL MATERIALS TO ALL PATIENTS BEING TREATED FOR A CONTROLLED SUBSTANCE OVER- DOSE BY SUCH HOSPITAL OR PHYSICIAN. § 2. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11179-01-7
