S T A T E O F N E W Y O R K ________________________________________________________________________ 7676 2017-2018 Regular Sessions I N A S S E M B L Y May 8, 2017 ___________ Introduced by M. of A. GJONAJ -- read once and referred to the Committee on Correction AN ACT to amend the correction law, in relation to making telephone services available for the deaf in every state and local correctional facility THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 623 of the correction law is amended by adding a new subdivision 5 to read as follows: 5. IN ACCORDANCE WITH THE AMERICANS WITH DISABILITIES ACT, OR ANY OTHER APPLICABLE FEDERAL, STATE OR LOCAL LAW, EVERY STATE AND LOCAL CORRECTIONAL FACILITY SHALL MAKE AVAILABLE TELEPHONE SERVICES FOR THE DEAF OR HARD OF HEARING IN ORDER TO ENSURE THAT INMATES WHO ARE DEAF OR HARD OF HEARING ARE ABLE TO COMMUNICATE WITH FRIENDS, FAMILY AND ATTOR- NEYS. EQUIPMENT PROCURED IN COMPLIANCE WITH THIS SUBDIVISION SHALL BE PERIODICALLY UPDATED TO ENSURE THAT SUCH SERVICES ARE PROVIDED USING REASONABLY CURRENT TECHNOLOGY. § 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
