 AN ACT to amend the education law, in relation  to  authorizing  private
   special  education schools to seek department approval to offer alter-
   native high school equivalency preparation programs

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 305 of the education law is amended by adding new
 subdivision 13-a to read as follows:
   13-A.  THE  COMMISSIONER  SHALL  PROMULGATE  REGULATIONS   AUTHORIZING
 PRIVATE  SPECIAL  EDUCATION SCHOOLS TO SEEK DEPARTMENT APPROVAL TO OPER-
 ATE, ADMINISTER, OFFER, OR OTHERWISE PARTICIPATE IN AN ALTERNATIVE  HIGH
 SCHOOL EQUIVALENCY PREPARATION PROGRAM.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.

 AN  ACT  to  amend the education law, in relation to authorizing private
   special education schools to seek department approval to offer  alter-
   native high school equivalency preparation programs
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 305 of the education law is amended by adding a new

 THAT STUDENTS SELECTED FOR AN ALTERNATIVE HIGH SCHOOL EQUIVALENCY PREPA-
 RATION PROGRAM IS LIMITED TO THOSE STUDENTS  WITH  A  CREDIT  DEFICIENCY
 THAT CANNOT BE MADE UP BEFORE THEY TURN TWENTY-ONE YEARS OF AGE.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.
