AN ACT to amend the education law, in relation to authorizing school
districts to establish rules and regulations to determine academic
eligibility requirements for school-sponsored extra-curricular activ-
ities
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 1604 of the education law is amended by adding a
new subdivision 43 to read as follows:
43. TO AUTHORIZE POLICIES ESTABLISHING RULES AND REGULATIONS, AS IT
DEEMS NECESSARY, THAT DETERMINE ACADEMIC ELIGIBILITY REQUIREMENTS AS A
CONDITION FOR STUDENT PARTICIPATION IN SCHOOL-SPONSORED EXTRACURRICULAR
ACTIVITIES.
§ 2. Section 1709 of the education law is amended by adding a new
subdivision 43 to read as follows:
43. TO AUTHORIZE POLICIES ESTABLISHING RULES AND REGULATIONS THAT
DETERMINE ACADEMIC ELIGIBILITY REQUIREMENTS AS A CONDITION FOR STUDENT
PARTICIPATION IN SCHOOL-SPONSORED EXTRACURRICULAR ACTIVITIES.
§ 3. Subdivision 4 of section 2503 of the education law is amended by
adding a new paragraph e to read as follows:
E. SHALL AUTHORIZE THE DEVELOPMENT OF POLICIES THAT SET ACADEMIC
ELIGIBILITY REQUIREMENTS AS A CONDITION FOR STUDENT PARTICIPATION IN
SCHOOL-SPONSORED EXTRACURRICULAR ACTIVITIES.
§ 4. Section 2554 of the education law is amended by adding a new
subdivision 28 to read as follows:
28. TO AUTHORIZE POLICIES ESTABLISHING RULES AND REGULATIONS, AS IT
DEEMS NECESSARY, THAT DETERMINE ACADEMIC ELIGIBILITY REQUIREMENTS AS A
CONDITION FOR STUDENT PARTICIPATION IN SCHOOL-SPONSORED EXTRACURRICULAR
ACTIVITIES.

§ 5. Section 2590-e of the education law is amended by adding a new
subdivision 3-a to read as follows:
3-A. PROMOTE POLICIES ESTABLISHING RULES AND REGULATIONS THAT DETER-
MINE ACADEMIC ELIGIBILITY REQUIREMENTS AS A CONDITION FOR STUDENT
PARTICIPATION IN SCHOOL-SPONSORED EXTRACURRICULAR ACTIVITIES.
§ 6. Subdivision 1 of section 2854 of the education law is amended by
adding a new paragraph (d-1) to read as follows:
(D-1) A CHARTER SCHOOL SHALL DEVELOP AND ADOPT POLICIES ESTABLISHING
STUDENT ACADEMIC ELIGIBILITY REQUIREMENTS AS A CONDITIONS TO PARTIC-
IPATION IN SCHOOL-SPONSORED EXTRACURRICULAR ACTIVITIES.
§ 7. This act shall take effect immediately; provided however that the
amendments to section 2590-e of the education law made by section five
of this act shall survive the expiration and reversion of such section
as provided in section 34 of chapter 91 of the laws of 2002, as amended.
