   Department) -- read once and referred to the  Committee  on  Ways  and
   Means
 
 AN  ACT  to amend the state finance law, in relation to establishing the
   board of regents institutional accreditation account  to  provide  the
   framework  for the state education department to spend monies received
   and/or revenues generated for  institutional  accreditation  purposes;
   and  to amend the education law, in relation to services and functions
   relating to institutional accreditation
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  state finance law is amended by adding a new section
 97-yyyy to read as follows:
   § 97-YYYY. BOARD OF REGENTS INSTITUTIONAL ACCREDITATION ACCOUNT.    1.
 THERE  IS  HEREBY  ESTABLISHED  IN  THE JOINT CUSTODY OF THE STATE COMP-
 TROLLER AND THE COMMISSIONER OF TAXATION AND FINANCE AN ACCOUNT  OF  THE
 MISCELLANEOUS  SPECIAL  REVENUE FUND TO BE KNOWN AS THE BOARD OF REGENTS
 INSTITUTIONAL ACCREDITATION ACCOUNT.
   2. NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE  CONTRARY,
 THE  STATE  COMPTROLLER IS HEREBY AUTHORIZED AND DIRECTED TO RECEIVE FOR
 DEPOSIT TO THE CREDIT OF THE BOARD  OF  REGENTS  INSTITUTIONAL  ACCREDI-
 TATION OPTION ACCOUNT, REVENUES GENERATED PURSUANT TO REGULATIONS OF THE
 COMMISSIONER  OF  EDUCATION  FOR  SERVICES  AND EXPENSES INCURRED BY THE
 STATE EDUCATION DEPARTMENT IN CONDUCTING ACCREDITATION  OF  INSTITUTIONS
 OF  HIGHER  EDUCATION OR APPROPRIATED OR OTHERWISE PROVIDED TO THE STATE
 EDUCATION DEPARTMENT FOR SUCH PURPOSES.
   § 2. Section 212 of the education law  is  amended  by  adding  a  new
 subdivision 8 to read as follows:
   8. TO PERFORM SERVICES AND FUNCTIONS RELATING TO INSTITUTIONAL ACCRED-
 ITATION.
   § 3. This act shall take effect immediately.
