 AN  ACT  to amend the social services law, in relation to identification
   and screening for deficiencies in executive functioning
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. The social services law is amended by adding a new section
 152-c to read as follows:
   § 152-C. SCREENING FOR DEFICIENCIES IN EXECUTIVE FUNCTIONING. 1.   THE
 COMMISSIONER  OF  THE  OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE, IN
 CONJUNCTION WITH THE COMMISSIONER OF MENTAL HEALTH AND ANY OTHER  APPRO-
 PRIATE  STATE  AGENCY  WHICH THE COMMISSIONER DEEMS NECESSARY, SHALL, BY
 JUNE THIRTIETH, TWO  THOUSAND  EIGHTEEN,  DEVELOP  A  PROGRAM  TO  TRAIN
 MEDICAL  PROFESSIONALS,  SOCIAL  SERVICES PROVIDERS, AND SOCIAL SERVICES
 EMPLOYEES TO IDENTIFY DEFICIENCIES IN EXECUTIVE FUNCTIONING. THE  OFFICE
 SHALL ALSO ESTABLISH A FACILITY OR FACILITIES FOR THE PURPOSE OF PROVID-
 ING  SCREENING  OF  INDIVIDUALS  FOR  SUCH DEFICIENCIES PURSUANT TO THIS
 SECTION. SUCH SCREENING PROGRAM AND FACILITIES  SHALL  BE  DEVELOPED  IN
 CONSULTATION  WITH  EXPERTS  IN  THE  STUDY OF EXECUTIVE FUNCTIONING AND
 SHALL UTILIZE RATING SCALES DESIGNED TO EVALUATE THE RANGE  OF  DEFICITS
 IN CLINIC-REFERRED OR HIGH-RISK INDIVIDUALS IN THEIR EXECUTIVE FUNCTION-
 ING.
   2.  FOR THE PURPOSES OF THIS SECTION, THE TERM "EXECUTIVE FUNCTIONING"
 SHALL MEAN THE USE OF SELF-DIRECTED ACTIONS,  INCLUDING  SELF-AWARENESS,
 SELF-MONITORING,  INHIBITION,  NON-VERBAL WORKING MEMORY, VERBAL WORKING
 MEMORY, PLANNING, AND PROBLEM-SOLVING, TO CHOOSE GOALS TO SELECT,  ENACT
 AND  SUSTAIN ACTIONS ACROSS TIME TOWARD THOSE GOALS FOR THE MAXIMIZATION
 OF ONE'S LONG-TERM WELFARE.
   § 2. This act shall take effect immediately.
