BENEDETTO, PHEFFER AMATO -- read once and referred to the Committee on Transpor- tation AN ACT to amend the vehicle and traffic law, in relation to the issuance of distinctive number plates for active duty members and veterans of the armed forces THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 404-ee to read as follows: § 404-EE. DISTINCTIVE PLATES FOR ACTIVE DUTY MEMBERS AND VETERANS OF THE ARMED FORCES. 1. ANY ACTIVE DUTY MEMBER OR VETERAN OF ANY BRANCH OF THE ARMED FORCES OF THE UNITED STATES OR THE SPOUSE OF ANY SUCH MEMBER OR VETERAN SHALL, UPON REQUEST, BE ISSUED A DISTINCTIVE NUMBER PLATE BEARING THE SEAL OF THE APPROPRIATE BRANCH OF THE ARMED FORCES BEING: THE UNITED STATES ARMY, THE UNITED STATES AIR FORCE, THE UNITED STATES COAST GUARD, THE UNITED STATES MARINE CORPS OR THE UNITED STATES NAVY. APPLICATION FOR SUCH NUMBER PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. THE DISTINCTIVE PLATE AUTHORIZED IN SUBDIVISION ONE OF THIS SECTION SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT OR THE SPOUSE OF THE APPLICANT IS AN ACTIVE DUTY MEMBER OR A VETERAN OF SUCH BRANCH OF THE ARMED FORCES OF THE UNITED STATES. 3. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE PROVIDED, HOWEVER, THAT AN ADDITIONAL ONE-TIME SERVICE CHARGE OF TEN DOLLARS SHALL BE CHARGED FOR SUCH PLATE. § 2. (a) A distinctive plate established pursuant to section 404-ee of the vehicle and traffic law shall only be designed, produced and issued EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
