 AN ACT to amend the education law, in relation to the  apportionment  of
   money to school districts for the purchase of opioid antagonists
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new  section  3609
 to read as follows:
   §  3609.  MONEYS APPORTIONED FOR THE REIMBURSEMENT FOR THE PURCHASE OF
 OPIOID ANTAGONISTS. 1. DEFINITIONS. (A) "SCHOOL DISTRICT" SHALL MEAN ALL
 PUBLIC SCHOOL DISTRICTS ELIGIBLE FOR TOTAL FOUNDATION  AID  PURSUANT  TO
 SUBDIVISION FOUR OF SECTION THIRTY-SIX HUNDRED TWO OF THIS ARTICLE.
   (B)  "OPIOID  ANTAGONIST"  MEANS  A DRUG APPROVED BY THE FOOD AND DRUG
 ADMINISTRATION THAT, WHEN ADMINISTERED, NEGATES OR NEUTRALIZES IN  WHOLE
 OR IN PART THE PHARMACOLOGICAL EFFECTS OF AN OPIOID IN THE BODY. "OPIOID
 ANTAGONIST" SHALL INCLUDE NALOXONE AND OTHER MEDICATIONS APPROVED BY THE
 NEW  YORK STATE DEPARTMENT OF HEALTH OR THE FOOD AND DRUG ADMINISTRATION
 FOR THE PURPOSE OF NEGATING OR NEUTRALIZING IN  WHOLE  OR  IN  PART  THE
 PHARMACOLOGICAL EFFECTS OF AN OPIOID IN THE BODY.
   2.  REIMBURSEMENT  FOR  THE  PURCHASE OF OPIOID ANTAGONISTS. (A) ON OR
 AFTER THE FIRST BUSINESS DAY OF JUNE OF  EACH  SCHOOL  YEAR,  COMMENCING
 JUNE  FIRST,  TWO  THOUSAND EIGHTEEN, A SCHOOL DISTRICT SHALL BE PAID AN
 AMOUNT EQUAL TO ONE HUNDRED PERCENT OF THE PAYMENTS MADE BY SUCH  SCHOOL
 DISTRICT FOR THE PURCHASE OF OPIOID ANTAGONISTS ON OR AFTER MAY FIRST OF
 THE PRIOR SCHOOL YEAR.
   (B)  ON  OR  BEFORE  MAY FIRST OF THE CURRENT SCHOOL YEAR, EACH SCHOOL
 DISTRICT SHALL SUBMIT RECEIPTS FOR THE PURCHASE OF  SUCH  OPIOID  ANTAG-
 ONISTS TO THE COMMISSIONER OF HEALTH. NO PAYMENT MAY BE MADE PURSUANT TO
 THIS  SECTION UNTIL SUCH AMOUNT FOR EACH SCHOOL DISTRICT IS CERTIFIED BY
 THE COMMISSIONER OF HEALTH AND TRANSMITTED  TO  THE  COMMISSIONER.  SUCH
