THIELE -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to requiring municipal approval of mining in residential neighborhoods THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 23-2711 of the environmental conservation law is amended by adding a new subdivision 1-a to read as follows: 1-A. AFTER SEPTEMBER FIRST, TWO THOUSAND EIGHTEEN, ANY PERSON WHO MINES OR PROPOSES TO MINE FROM A MINE SITE IN AN AREA ZONED RESIDENTIAL BY THE MUNICIPALITY IN WHICH THE MINE IS LOCATED SHALL NOT ENGAGE IN SUCH MINING UNLESS SUCH PERSON HAS OBTAINED APPROVAL OF SUCH MINING FROM THE GOVERNING BOARD OF SUCH MUNICIPALITY. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13819-01-7
