Provides that any special act school districts established pursuant to Chapter 566 of the Laws of 1967 shall be held harmless from any reduction in tuition revenue or any tuition rate calculation and/or rate reconciliation arising out of intake closure or limits on the entry of new student placements.

 AN ACT relating to tuition revenue and  tuition  rate  calculations  and
   rate reconciliation for certain special act school districts
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Notwithstanding any provision of law, rule,  or  regulation
 to the contrary, any special act school district established pursuant to
 Chapter  566  of  the  Laws  of  1967,  as amended, subject to an intake
 closure or limit on the entry of new student placements during  the  two
 thousand sixteen--two thousand seventeen school year or the two thousand
 seventeen--two  thousand  eighteen  school  year  by  the New York State
 Office of Children and Family Services or the New York State  Office  of
 Mental  Health,  shall  be  held  harmless from any reduction in tuition
 revenue or any tuition rate calculation and/or rate reconciliation aris-
 ing out of such intake closure or limit on  the  entry  of  new  student
 placements  during  the  two  thousand  sixteen--two  thousand seventeen
 school year or the two thousand seventeen--two thousand eighteen  school
 year. The commissioner of education is hereby directed to substitute two
 thousand fifteen--two thousand sixteen school year pupil counts reported
 by  any  special  act  school  district  under this act to calculate and
 finalize any tuition rate and/or tuition rate  reconciliation  for  such
 special  act  school  district and shall submit such tuition rate and/or
 tuition rate reconciliation to the director of the budget and the direc-
 tor of the budget is hereby directed to approve such submittal.  In  the
 event  such  special  act  school  district  under  this  act sustains a
 reduction in tuition revenue for the two thousand sixteen--two  thousand
 seventeen  school year or the two thousand seventeen--two thousand eigh-
 teen  school  year,  the  school  district  shall  submit  a  claim  for
 reimbursement  to  the  commissioner of education no later than July 31,
 2018 for the amount of such reduction in tuition  revenue  including  an
 accounting  in  writing  of  how  such  reduction in tuition revenue was
 calculated and the director of the budget is hereby directed to  approve
 and pay such claim.
   ยง 2. This act shall take effect immediately.
