 TITLE OF BILL :

An act to amend the insurance law, in relation to directing the New
York state health care quality and cost containment commission to
study and report upon the impact of requiring that certain health
insurance plans provide coverage for treatment of mitochondrial
disease

 PURPOSE :

Directs the health care quality and cost containment commission to
study and report upon the impact of requiring that certain health
insurance plans provide coverage for treatment of mitochondrial
disease.

 SUMMARY OF PROVISIONS :

Section 1. Amends section 213 of the insurance law by adding a new
subdivision (e)

Section 3. Establishes the effective date.

 JUSTIFICATION :

It is estimated that more than 1 in 4000 people suffer from
mitochondrial disease. Patients with mitochondrial disease have
mitochondria that cannot efficiently turn sugar and oxygen into
energy. This disease has the potential to impact every organ of the
body and is marked by highly variable symptoms. Some patients have had
success in mitigating symptoms of the disease through the use of
certain vitamins and supplements which are not currently covered by
insurance companies. In particular, children who are born with this
disease need to obtain necessary treatment which is critical to
prevent cognitive and learning disabilities later in life. When they
are financially able to, patients spend hundreds of dollars on their
own and have had positive outcomes which minimizes costs to the health
care system.

This bill will be the first step in addressing a solution to this
issue. Although mitochondria! disease indicates small in many ways, it
is large in cost and quality of life for those affected.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 213 of the insurance law is amended by adding a new
 subsection (e) to read as follows:
   (E) THE COMMISSION SHALL CAUSE A STUDY TO BE PERFORMED ON  THE  IMPACT
 OF  REQUIRING  CERTAIN  HEALTH  INSURANCE  PLANS TO PROVIDE COVERAGE FOR
 TREATMENT OF MITOCHONDRIAL DISEASE. SUCH STUDY SHALL INCLUDE AN  ASSESS-
 MENT OF THE IMPACT OF SUCH A REQUIREMENT ON COSTS TO PROVIDERS, THE COST
 OF  INSURANCE  PREMIUMS, AND THE FISCAL IMPACT TO THE STATE. THE COMMIS-
 SION SHALL SUBMIT A REPORT OF THE FINDINGS, CONCLUSIONS AND  RECOMMENDA-
 TION  OF SUCH STUDY, ON OR BEFORE NOVEMBER THIRTIETH, TWO THOUSAND EIGH-
