BILL NUMBER: S1334 TITLE OF BILL : An act to amend the public health law, in relation to establishing protocols for stillbirths and establishing a stillbirth research database PURPOSE : The purpose for this bill is to have the commissioner, medical examiners, nurses, psychologists, and social workers develop and prescribe regulations for comprehensive policies and procedures to healthcare facilities that provide birthing and newborn care in the case of a stillbirth. SUMMARY OF PROVISIONS : As a condition of licensure a health care facility providing birthing services and newborn care will adhere to the following, at minimum: One doctor should be assigned to the family who will inform them of the state of fetus as well as inform and coordinate staff to assist with post-mortem procedures, Guidelines will be established to assess the family's awareness re: stillbirth,

COMRIE, ADDABBO, PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to establishing protocols for stillbirths and establishing a stillbirth research data- base THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 206 of the public health law is amended by adding a new subdivision 31 to read as follows: 31. (A) THE COMMISSIONER, IN CONSULTATION WITH THE STATE BOARD OF MEDICAL EXAMINERS, THE NEW YORK BOARD OF NURSING, THE STATE BOARD FOR PSYCHOLOGY, AND THE STATE BOARD FOR SOCIAL WORK, SHALL DEVELOP AND PRESCRIBE BY REGULATION COMPREHENSIVE POLICIES AND PROCEDURES TO BE FOLLOWED BY HEALTH CARE FACILITIES THAT PROVIDE BIRTHING AND NEWBORN CARE SERVICES IN THE STATE WHEN A STILLBIRTH OCCURS. (B) THE COMMISSIONER SHALL REQUIRE AS A CONDITION OF LICENSURE THAT EACH HEALTH CARE FACILITY IN THE STATE THAT PROVIDES BIRTHING AND NEWBORN CARE SERVICES ADHERE TO THE POLICIES AND PROCEDURES PRESCRIBED IN THIS SUBDIVISION. THE POLICIES AND PROCEDURES SHALL INCLUDE, AT A MINIMUM: (I) PROTOCOLS FOR ASSIGNING PRIMARY RESPONSIBILITY TO ONE PHYSICIAN, WHO SHALL COMMUNICATE THE CONDITION OF THE FETUS TO THE MOTHER AND FAMI- LY, AND INFORM AND COORDINATE STAFF TO ASSIST WITH LABOR, DELIVERY, AND POSTMORTEM PROCEDURES; (II) GUIDELINES TO ASSESS A FAMILY'S LEVEL OF AWARENESS AND KNOWLEDGE REGARDING THE STILLBIRTH; (III) THE ESTABLISHMENT OF A BEREAVEMENT CHECKLIST, AND AN INFORMA- TIONAL PAMPHLET TO BE GIVEN TO A FAMILY EXPERIENCING A STILLBIRTH THAT INCLUDES INFORMATION ABOUT FUNERAL AND CREMATION OPTIONS; (IV) PROVISION OF ONE-ON-ONE NURSING CARE FOR THE DURATION OF THE MOTHER'S STAY AT THE FACILITY; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
