 TITLE OF BILL :

An act to amend the education law, in relation to in-state tuition at
colleges and universities of the state university of New York and the
city university of New York

 PURPOSE :

Provides for in-state tuition at colleges and universities of state
university, the city university of New York and community colleges for
honorably discharged veterans attending under the federal GI bills.

 SUMMARY OF SPECIFIC PROVISIONS :

Sections 355, 6206, and 6301 of the education law are amended to
provide that the payment of tuition and fees by any student who is not
a resident of New York state, shall be paid at a rate or charge no
greater than that imposed for students who are residents of the state
if such student was honorably discharged from the armed forces of the
United States and is enrolled within twelve months of such discharge
in a SUNY or CUNY school in accordance with the federal GI bills.

 JUSTIFICATION :

Many veterans serve overseas for extended periods and pursue a college
education upon their return to the United States.  Veterans are
entitled to receive up to $17,500 a year from the federal government
if they attend a private school. In New York State, veterans often
lose their status as a New York State resident because of their
overseas service, and when they seek to attend a state institution
they are forced to pay as a non-resident. This financially penalizes
veterans for relocating for their job and steers veterans to attend
private schools rather than a SUNY or CUNY institution.

Residency requirements exist to help New York state residents receive
a quality education at an affordable price. It would be fair to extend
this option to veterans who have returned to or chose to reside in New
York State immediately following their service.

 AN ACT to amend the education law, in relation to  in-state  tuition  at
   colleges  and universities of the state university of New York and the
   city university of New York

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Clause (iii) of subparagraph 8 of paragraph h of subdivi-
 sion 2 of section 355 of the education law, as added by chapter  327  of
 the  laws  of 2002, is amended and a new clause (iv) is added to read as
 follows:
   (iii) was enrolled in an institution or educational unit of the  state
 university  in the fall semester or quarter of the two thousand one--two
 thousand two academic year and was authorized  by  such  institution  or
 educational  unit  to  pay  tuition  at  the  rate or charge imposed for
 students who are residents of the state[.]; OR
   (IV) WAS HONORABLY DISCHARGED FROM THE  ARMED  FORCES  OF  THE  UNITED
 STATES  AND  IS  ENROLLED, WITHIN TWELVE MONTHS OF SUCH DISCHARGE, IN AN
 INSTITUTION OR EDUCATIONAL UNIT OF THE STATE UNIVERSITY, AND IS  ATTEND-
 ING  SUCH INSTITUTION OR EDUCATIONAL UNIT IN ACCORDANCE WITH THE FEDERAL
 GI BILLS.
   § 2. Subparagraph (iii) of paragraph (a-1) of subdivision 7 of section
 6206 of the education law, as amended by chapter  260  of  the  laws  of
 2011,  is  amended  and  a  new  subparagraph  (iv)  is added to read as
 follows:
   (iii) was enrolled in an institution or educational unit of  the  city
 university  in the fall semester or quarter of the two thousand one--two
 thousand two academic year and was authorized  by  such  institution  or
 educational  unit  to  pay  tuition  at  the  rate or charge imposed for
 students who are residents of the state[.]; OR

  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   (IV) WHO WAS HONORABLY DISCHARGED FROM THE ARMED FORCES OF THE  UNITED
 STATES  AND  IS  ENROLLED, WITHIN TWELVE MONTHS OF SUCH DISCHARGE, IN AN
 INSTITUTION OR EDUCATIONAL UNIT OF THE CITY UNIVERSITY, AND IS ATTENDING
 SUCH INSTITUTION OR EDUCATIONAL UNIT IN ACCORDANCE WITH THE  FEDERAL  GI
 BILLS.

 BILLS.
   § 4. Paragraph (iii) of subdivision 5 of section 6301 of the education
 law, as amended by chapter 327 of the laws of 2002, is amended and a new
 paragraph (iv) is added to read as follows:
   (iii)  was enrolled in an institution or educational unit of the state
 university in the fall semester or quarter of the two thousand  one--two
 thousand  two  academic  year  and was authorized by such institution or
 educational unit to pay tuition  at  the  rate  or  charge  imposed  for
 students who are residents of the state[.]; OR
   (IV)  WHO WAS HONORABLY DISCHARGED FROM THE ARMED FORCES OF THE UNITED
 STATES AND IS ENROLLED, WITHIN TWELVE MONTHS OF  SUCH  DISCHARGE,  IN  A
 COMMUNITY  COLLEGE  UNDER  THE  PROGRAM  OF THE STATE UNIVERSITY, AND IS
 ATTENDING SUCH COMMUNITY COLLEGE  IN  ACCORDANCE  WITH  THE  FEDERAL  GI
 BILLS.
   §  5.  This act shall take effect immediately; provided, however, that
 the amendments to paragraph (a-1) of subdivision 7 of  section  6206  of
 the  education law, made by section two of this act, shall be subject to
 the expiration and reversion of such paragraph pursuant to section 16 of
 chapter 260 of the laws of 2011, when upon such date the  provisions  of
 section three of this act shall take effect.
