 Introduced  by  Sen.  AVELLA -- read twice and ordered printed, and when
   printed to be committed to the Committee on Transportation
 
 AN ACT to amend the vehicle and traffic law, in relation  to  non-driver
   identification cards for persons aged sixty-two years of age or older
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 490 of the vehicle and traffic law  is  amended  by
 adding a new subdivision 2-a to read as follows:
   2-A.  PERSONS  AGED SIXTY-TWO YEARS OF AGE OR OLDER. WHERE THE DEPART-
 MENT REVOKES THE DRIVER'S LICENSE OF A PERSON AGED  SIXTY-TWO  YEARS  OF
 AGE  OR  OLDER,  THE  DEPARTMENT SHALL AUTOMATICALLY ISSUE SUCH PERSON A
 NON-DRIVER IDENTIFICATION CARD.
   § 2. Subparagraph (iii) of paragraph (a) of subdivision 3  of  section
 490  of the vehicle and traffic law, as added by chapter 575 of the laws
 of 2006, is amended to read as follows:
   (iii) Notwithstanding any other law, rule or regulation to the contra-
 ry, a person who is sixty-two years of age or older and who is a recipi-
 ent of supplemental security income benefits who has not been  issued  a
 driver's  license,  or whose driver's license is expired, or who surren-
 dered his or her driver's license, OR WHOSE DRIVER'S  LICENSE  HAS  BEEN
 REVOKED BY THE DEPARTMENT shall be issued an identification card without
 the payment of any fee, upon submitting the appropriate application.
   § 3. This act shall take effect on the one hundred eightieth day after
 it shall have become a law; provided, however, that effective immediate-
 ly,  the  addition,  amendment  and/or  repeal of any rule or regulation
 necessary for the implementation of this act on its  effective  date  is
 authorized  and  directed  to  be  made  and completed on or before such
 effective date.
