 TITLE OF BILL :

An act to repeal chapter 1 of the laws of 2013, amending the criminal
procedure law and other laws relating to suspension and revocation of
firearms licenses; private sale or disposal of firearms, rifles or
shotguns and establishing a minimum age to possess a firearm relating
to gun control

 PURPOSE :

An act to repeal Chapter 1 of the Laws of 2013, amending the Criminal
Procedure Law and other laws relating to the suspension and revocation
of the disposal of firearms licenses; private sale or disposal of
firearms, rifles, or shotguns and establishing a minimum age to
possess a firearm relating to gun control.

 SUMMARY OF PROVISIONS :

The entirety of Chapter 1 would be repealed.

 JUSTIFICATION :

The "New York Secure Ammunition and Firearms Enforcement Act of 2013"
commonly referred to as the "SAFE Act," has been the most
              

controversial, contentious and divisive law ever enacted in the
history of the Empire State. Enacted into law through a Message of
Necessity without a single public hearing or opportunity for citizens
to comment, the SAFE Act is an unconstitutional and thus illegal law
that eroded the Second Amendment freedoms of all New Yorkers,
criminalized millions of law-abiding citizens and imposed a costly,
massive new unfunded mandate on local governments and local taxpayers.
The SAFE Act undermines the right to keep and bear arms, which is
guaranteed to every American and enshrined in the Constitution of the
United States to safeguard all our liberties against tyranny.

Just as the Minutemen and colonial militia stood against oppression at
Lexington and Concord, so too have millions of freedom-loving,
law-abiding New Yorkers stood strong against Governor Cuomo's SAFE
Act. Nearly every County government across the State has passed a
legislative resolution opposing the SAFE Act, as have 51 Sheriffs and
numerous law enforcement organizations. In the few months that the
SAFE Act has been law in New York State, it has already caused chaos
and confusion, needlessly subjecting citizens to potential prosecution
that is wholly unconstitutional.

While various legislative remedies have been introduced that address
some of the most egregious and unconstitutional parts of the SAFE Act,
the inescapable reality is that the SAFE Act must be completely
repealed before this reckless law can do even more damage to the
Second Amendment freedoms that New Yorkers depend upon. This
legislation - the "UN-SAFE Act Repealer" - would repeal the SAFE Act
in its entirety.
