 Introduced by Sen. ALCANTARA -- read twice and ordered printed, and when
   printed to be committed to the Committee on Codes
 
 AN  ACT  to  amend the penal law, in relation to the use of coercion for
   the purpose of exposing a person's immigration status
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  9  of  section  135.60  of the penal law, as
 amended by chapter 426 of the laws of 2008, is amended and a new  subdi-
 vision 10 is added to read as follows:
   9.  Perform any other act which would not in itself materially benefit
 the actor but which is calculated to harm another person materially with
 respect to his or her health, safety, business, calling, career,  finan-
 cial condition, reputation or personal relationships[.]; OR
   10.  EXPOSE IMMIGRATION STATUS, REGARDLESS OF THE ACTOR'S KNOWLEDGE OF
 SUCH STATUS.
   § 2. Paragraph (c) of subdivision 2 of section  135.65  of  the  penal
 law, as amended by chapter 426 of the laws of 2008, is amended and a new
 paragraph (d) is added to read as follows:
   (c) Violate his or her duty as a public servant[.]; OR
   (D) EXPOSE HIS OR HER OWN IMMIGRATION STATUS.
   § 3. This act shall take effect on the first of November next succeed-
 ing the date on which it shall have become a law.
