   printed to be committed to the Committee on Social Services
 
 AN ACT to amend the social services law, in relation to electronic bene-
   fit system transfer technology and reimbursements for the use of  such
   technology

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 21-a of the  social  services  law  is  amended  by
 adding a new subdivision 3 to read as follows:
   3. (A) THE DEPARTMENT SHALL DEVISE A MEANS BY WHICH ELECTRONIC BENEFIT
 TRANSFERS  MADE  THROUGH TECHNOLOGY AVAILABLE AT FARMERS' MARKETS MAY BE
 RECOGNIZED AS HAVING OCCURRED AT SUCH LOCATIONS.
   (B) NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE CONTRARY,
 AND SUBJECT TO AN APPROPRIATION THEREFOR, FOR  PURCHASES  AT  DESIGNATED
 FARMERS'  MARKET  LOCATIONS  THROUGH  THE  USE OF AN ELECTRONIC BENEFITS
 TRANSFER CARD, THE AVAILABLE BALANCE OF SUPPLEMENTAL  NUTRITION  ASSIST-
 ANCE  PROGRAM  BENEFITS  AVAILABLE  SHALL BE CALCULATED AT A RATE OF ONE
 HUNDRED FIFTY PERCENT OF THE AMOUNT OTHERWISE PROVIDED OF SUCH REMAINING
 BALANCE.
   § 2. This act shall take effect on the sixtieth  day  after  it  shall
 have  become  a  law; provided, however, that effective immediately, the
 addition, amendment and/or repeal of any rule  or  regulation  necessary
 for  the implementation of this act on its effective date are authorized
 and directed to be made and completed on or before such effective date.
