BILL NUMBER: S361 TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to authorizing the state liquor authority to retain monies collected as fines for use for the operational purposes of the state liquor authority PURPOSE OF BILL : Authorizes the state liquor authority to retain monies collected as fines for use for the operational purposes of the state liquor authority SUMMARY OF SPECIFIC PROVISIONS : Section 1 adds a new Subdivision 6 to Section 130 of the Alcoholic Beverage Control Law. Section 2 establishes the effective date. JUSTIFICATION : Under the State's current fiscal landscape, fines collected by the State Liquor Authority are swept into the General Fund. Fostering the

PERALTA -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to authorizing the state liquor authority to retain monies collected as fines for use for the operational purposes of the state liquor author- ity THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 130 of the alcoholic beverage control law is amended by adding a new subdivision 6 to read as follows: 6. ANY FINES COLLECTED PURSUANT TO THE PROVISIONS OF THIS SECTION SHALL BE RETAINED BY THE LIQUOR AUTHORITY AND SHALL BE USED FOR THE OPERATIONAL PURPOSES OF THE LIQUOR AUTHORITY, INCLUDING BUT NOT LIMITED TO LIQUOR AUTHORITY ENFORCEMENT ACTIVITIES THROUGHOUT THE STATE. § 2. This act shall take effect on the first of January next succeed- ing the date upon which it shall have become a law.
