BILL NUMBER: S38 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to increasing the penalties for leaving the scene of an incident involving a wheeled non-motorized means of conveyance PURPOSE OR GENERAL IDEA OF BILL : This legislation would make the penalties for leaving the scene of a bicycle crash consistent with the penalties for leaving the scene of an automobile crash. SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill amends subdivision 2 of section 1240 of the vehicle and traffic law to make leaving the scene of an incident involving a wheeled non-motorized means of conveyance without reporting in the second degree a class A misdemeanor. Section 2 of the bill amends subdivision 2 of section 1241 of the vehicle and traffic law to make leaving the scene of an incident involving a wheeled non-motorized means of conveyance without reporting in the first degree a class E felony. Section 3 of the bill provides that the act shall take effect immediately.

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to increasing the penalties for leaving the scene of an incident involving a wheeled non-motorized means of conveyance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 1240 of the vehicle and traffic law, as added by chapter 468 of the laws of 2001, is amended to read as follows: 2. Leaving the scene of an incident involving a wheeled non-motorized means of conveyance without reporting in the second degree is a [violation] CLASS A MISDEMEANOR. § 2. Subdivision 2 of section 1241 of the vehicle and traffic law, as added by chapter 468 of the laws of 2001, is amended to read as follows: 2. Leaving the scene of an incident involving a wheeled non-motorized means of conveyance without reporting in the first degree is a class [B misdemeanor] E FELONY. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05849-01-7
