BILL NUMBER: S4066 TITLE OF BILL : An act to amend chapter 380 of the laws of 2005 relating to establishing the Chemung county library district, in relation to the election of members of the board of trustees PURPOSE OR GENERAL IDEA OF BILL : To simplify the Chemung County Library District voting process. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends subdivision 2 of section 2 of chapter 380 of the laws of 2005 relating to establishing Chemung county library district. Section 2 establishes the effective date. JUSTIFICATION : The Chemung County Board of Elections formally requested that the Library District make a change to simplify the voting process. The Chemung County Board of Elections is in charge of both the District's budget vote and the election of trustees. The election of trustees and the Board of Elections terms do not align with the Chemung County legislature. Furthermore, the timetable for Library pre-election procedures does not coincide with the County procedures. Accordingly,

O'MARA -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend chapter 380 of the laws of 2005 relating to establishing the Chemung county library district, in relation to the election of members of the board of trustees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 2 of chapter 380 of the laws of 2005 relating to establishing the Chemung county library district, is amended to read as follows: 2. In the event that the Chemung county library district is created, there shall be an annual election conducted by the board of trustees of the district in accordance with the election procedures provided in subdivision one of this section, at a time to be set by the district board, at which election vacancies on the board of trustees shall be filled [and at which any]. ANY proposed budget which the board shall determine to submit to the voters pursuant to section four of this act shall be submitted to the voters AT THE ANNUAL ELECTION CONDUCTED BY THE TRUSTEES AS SET FORTH IN THIS SUBDIVISION OR AT THE ANNUAL GENERAL ELECTION CONDUCTED BY THE LOCAL BOARD OF ELECTIONS. § 2.
