BILL NUMBER: S5332 TITLE OF BILL : An act to amend the mental hygiene law and the education law, in relation to establishing the urban youth gun violence reduction pilot program; making an appropriation therefor; and providing for the repeal of certain provisions upon expiration thereof PURPOSE OR GENERAL IDEA OF BILL : The bill acknowledges the proliferation of gun violence which is often connected to mental health issues. The purpose of the bill is to significantly reduce gun violence by providing additional resources to participating schools in participating districts to identify mental health issues and establish appropriate curriculums for various age ranges on the issue. The pilot program will be targeted to serve communities with the highest level of gun related homicides and gun related injuries. SUMMARY OF SPECIFIC PROVISIONS : Section 2. Provides definitions for important terms such as "Establishment", "Social worker services", "Youth mental health first aid training", "Mental health curriculums". HAMILTON -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the mental hygiene law and the education law, in relation to establishing the urban youth gun violence reduction pilot program; making an appropriation therefor; and providing for the repeal of certain provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "urban youth gun violence reduction pilot program". § 2. Title B of the mental hygiene law is amended by adding a new article 11 to read as follows: ARTICLE 11 URBAN YOUTH GUN VIOLENCE REDUCTION PILOT PROGRAM SECTION 11.01 DEFINITIONS. 11.03 ESTABLISHMENT. 11.05 SOCIAL WORKER SERVICES. 11.07 YOUTH MENTAL HEALTH FIRST AID TRAINING. 11.09 MENTAL HEALTH CURRICULUMS. § 11.01 DEFINITIONS. AS USED IN THIS ARTICLE: (A) "GUN VIOLENCE" MEANS PHYSICAL INJURIES AND DEATHS CAUSED BY THE USE OF FIREARMS. (B) "MENTAL HEALTH FIRST AID" MEANS THE RECOGNITION OF THE SYMPTOMS OF COMMON MENTAL ILLNESSES AND CHEMICAL DEPENDENCY; THE SAFE DE-ESCALATION OF CRISIS SITUATIONS; AND THE INITIATION OF TIMELY REFERRAL OF APPROPRI- ATE STUDENTS TO MENTAL HEALTH AND CHEMICAL DEPENDENCY RESOURCES WITHIN THE COMMUNITY. (C) "PROGRAM" MEANS THE URBAN YOUTH GUN VIOLENCE REDUCTION PILOT PROGRAM ESTABLISHED IN SECTION 11.03 OF THIS ARTICLE. The education law is amended by adding a new section 319 to read as follows: § 319. YOUTH VIOLENCE PREVENTION PILOT PROGRAM. 1. SUBJECT TO AVAIL- ABLE APPROPRIATIONS, THE COMMISSIONER SHALL ESTABLISH A PILOT PROGRAM FOR THE PREVENTION OF YOUTH VIOLENCE. THE COMMISSIONER SHALL SELECT SCHOOL DISTRICTS TO PARTICIPATE IN THE PILOT PROGRAM THAT HAVE DEMON- STRATED A NEED BASED ON FACTORS, INCLUDING, BUT NOT LIMITED TO, HIGH RATES OF ABSENTEEISM, HIGH RATES OF SUSPENSIONS, DESIGNATION OF PERSIS- TENTLY DANGEROUS SCHOOL, AND OTHER FACTORS AS DETERMINED BY THE COMMIS- SIONER. 2. THE PROGRAM SHALL PROVIDE GRANT AID FOR THE EMPLOYMENT OF MENTAL HEALTH PROFESSIONALS WITHIN PARTICIPATING SCHOOL DISTRICTS INCLUDING, BUT NOT LIMITED TO, SOCIAL WORKERS, SCHOOL PSYCHOLOGISTS, AND COUNSE- LORS. 3. TO BE CONSIDERED FOR THE PILOT PROGRAM, A SCHOOL DISTRICT SHALL SUBMIT A PROPOSAL TO THE COMMISSIONER DETAILING: (A) THE REASONS WHY THE DISTRICT SEEKS TO PARTICIPATE IN THIS PILOT; (B) THE SCHOOL DISTRICT'S BARRIERS TO HIRING MENTAL HEALTH PROFES- SIONALS; AND (C) THE ROLE THAT MENTAL HEALTH PROFESSIONALS WOULD PROVIDE IF SELECTED FOR THE PILOT. 4. THE COMMISSIONER SHALL ESTABLISH RULES AND REGULATIONS NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. § 2. This act shall take effect immediately.
