 TITLE OF BILL :

An act to amend the administrative code of the city of New York and
the vehicle and traffic law, in relation to increasing the fine for
tractor-trailer combinations that park on residential streets
overnight

 PURPOSE :

To reduce overcrowding and parking on residential streets by
commercial vehicles.

 SUMMARY OF PROVISIONS :

Section 1 amends paragraph e of subdivision 2 of section 19-170 of the
administrative code of the City is amended impose a $400 fine for a
first violation of this section by any commercial vehicle, including
tractor-trailer combinations, truck trailer or semi-trailer. Any
subsequent violation of this section by the same owner within a six
month period shall receive a monetary fine of $500.

Section 2 amends section 237 of the vehicle and traffic law that in a
city of a million or more, and commercial vehicle that violates the
law can receive a monetary fine of $400 for a first offense and $500

for any subsequent offense within six months.

Section 3 enactment date.

 JUSTIFICATION :

Southeast Queens sits between two of the busiest airports in the
country, JFK and LaGaurdia, and hosting a large import-export
businesses that distributes food, materials, and supplies to local
establishments from all around the world, Southeast Queens takes pride
in the fact that we are able to have such a large impact on the
economic growth of our City.

Unfortunately, hosting these businesses and airports has put a strain
on our communities. While commercial trucks have a place to pick up
and drop off the supplies they are delivering, there is no place for
them to park. So between overnight shifts, they reside in our
residential communities taking up spaces in front of houses, not just
creating an eye sore but it is also an environmental hazard and
troublesome for families.

Southeast Queens is designated as an extreme transit dessert by the
federal government, where it takes residents an hour and a half to get
to midtown Manhattan by public transportation. That is why families
here rely on cars for their everyday needs. Many of them also have
more than one vehicle, so they need the space near their homes to
easily drop their children off at school, run errands, and get to a
from work. Needless to say, this becomes more difficult when a 16
wheeler is parked in front of your house. The truck drivers also leave
their air conditioners or heaters on as they sleep overnight.

This continues to be one of the major issues many offices and
community boards receive complaints about, and which civic
organizations and others discuss at their meetings.

This legislation will reduce this hazard if it becomes law, truck
drivers will think twice before parking on residential streets,
enhancing the quality of life for residents of Southeast Queens.

This act shall take effect ninety days after it shall have become law.

 AN ACT to amend the administrative code of the city of New York and  the
   vehicle  and traffic law, in relation to increasing the fine for trac-
   tor-trailer combinations that park on residential streets overnight

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  2  of  subdivision  c of section 19-170 of the
 administrative code of the city of New York, as added by chapter 458  of
 the laws of 2010, is amended to read as follows:
   2. A first violation of this section, when the commercial vehicle is a
 tractor-trailer  combination,  tractor,  truck  trailer or semi-trailer,
 shall be punishable by a monetary  fine  of  [two  hundred  fifty]  FOUR
 HUNDRED  dollars.  Any  such subsequent violation of this section by the
 same owner, as defined in paragraph a of subdivision one of section  two
 hundred  thirty-nine  of the vehicle and traffic law, within a six month
 period shall be punishable by a monetary fine of five hundred dollars.
   § 2. Subdivision 2 of section 237 of the vehicle and traffic  law,  as
 amended  by  chapter  458  of  the  laws  of 2010, is amended to read as
 follows:
   2. To provide for penalties other than imprisonment  for  (a)  parking
 violations  in  accordance  with a schedule of monetary fines and penal-
 ties, provided however, that monetary penalties shall not  exceed  fifty
 dollars for each parking violation other than (i) in a city with a popu-
 lation  of  one  million  or  more, violations committed in spaces where
 stopping or standing is prohibited for which  monetary  penalties  shall
 not  exceed one hundred dollars and, (ii) handicapped parking violations
 for which monetary penalties shall not exceed one hundred fifty dollars;
 and (b) abandoned vehicle violations, except in a city with a population
 of one million or more, provided however, that monetary penalties  shall
 not  be  less  than two hundred fifty dollars nor more than one thousand

 dollars for each abandoned vehicle violation; and  (c)  a  city  with  a
 population of one million or more may impose a monetary penalty of up to
 [two  hundred  fifty] FOUR HUNDRED dollars for a first offense and up to
 five  hundred  dollars for subsequent offenses within a six month period
 for tractor-trailer combinations, tractors,  truck  trailers  and  semi-
 trailers parked overnight on streets in residential neighborhoods;
   §  3.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
