BILL NUMBER: S5560 TITLE OF BILL : An act to amend the environmental conservation law, in relation to establishing the financial assistance to business program PURPOSE OR GENERAL IDEA OF BILL : To establish, develop and implement a financial assistance to business program to provide assistance to dry cleaning businesses and nail salons to upgrade equipment to meet certain environmental standards. SUMMARY OF PROVISIONS : Section 1 of the bill amends the environmental conservation law by adding a new section 28-0114 to establish, develop and implement a financial assistance to business program to provide assistance to dry cleaning businesses for non-perchloroethylene machines and sprinkler systems and to nail salons for upgrades to mechanical ventilation systems to comply with air quality regulations. Section 2 sets a 90-day effective date. JUSTIFICATION :

AVELLA -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to establishing the financial assistance to business program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 28-0114 to read as follows: § 28-0114. FINANCIAL ASSISTANCE TO BUSINESS PROGRAM. 1. THE ENVIRONMENTAL FACILITIES CORPORATION IS HEREBY AUTHORIZED AND DIRECTED TO ESTABLISH, DEVELOP AND IMPLEMENT A FINANCIAL ASSISTANCE TO BUSINESS PROGRAM. THE PURPOSE OF SUCH PROGRAM SHALL BE TO PROVIDE FINAN- CIAL ASSISTANCE TO: A. DRY CLEANING BUSINESSES FOR NON-PER-CHLORETHYLENE MACHINES AND SPRINKLER SYSTEMS; AND B. NAIL SALONS FOR UPGRADES TO MECHANICAL VENTILATION SYSTEMS TO COMPLY WITH AIR QUALITY REGULATIONS. 2. THE ENVIRONMENTAL FACILITIES CORPORATION SHALL PROMULGATE ALL NECESSARY RULES AND REGULATIONS TO CARRY OUT THE PROGRAM AND SHALL PROVIDE STATE FINANCIAL ASSISTANCE PAYMENTS TO SUCH PROGRAM FROM FUNDS APPROPRIATED THEREFOR. § 2. This act shall take effect on the ninetieth day after it shall have become a law; provided that, effective immediately, the addition, amendment, and/or repeal of any rules and regulations necessary to implement the provisions of this act on its effective date are author- ized and directed to be completed on or before such effective date.
