BILL NUMBER: S5975 TITLE OF BILL : An act to amend the education law, in relation to the regents establishing a process for colleges to become universities PURPOSE : To establish a process for colleges to become universities SUMMARY OF PROVISIONS Section 1 of the bill adds a new Section 216-d to the Education Law to establish a process by which the regents may allow a college to become a university. Section 2 of the bill provides that the bill is effective 180 days after enactment. EXISTING LAW : New York Education Law Section 224 (1) prohibits an organization from using the name "university" unless the Board of Regents has authorized it to use that designation. In 1968, the Board of Regents adopted the following regulation: University means a higher education institution

FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to the regents establish- ing a process for colleges to become universities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 216-d to read as follows: § 216-D. PROCESS FOR BECOMING A UNIVERSITY. 1. THE REGENTS SHALL ESTABLISH A PROCESS FOR COLLEGES TO BE ALLOWED TO BECOME A UNIVERSITY WHERE THE COLLEGE: A. IS AUTHORIZED BY THE REGENTS TO OFFER AT LEAST THE FOLLOWING: (I) A RANGE OF UNDERGRADUATE PROGRAMS; (II) FIFTEEN MASTER'S PROGRAMS; AND (III) ONE DOCTORAL PROGRAM; AND B. MEETS OR EXCEEDS ANY OTHER REQUIREMENT DEEMED NECESSARY BY THE REGENTS. 2. UPON APPLICATION BY A COLLEGE MEETING THE REQUIREMENTS IN SUBDIVI- SION ONE OF THIS SECTION, THE REGENTS SHALL, IN A TIMELY MANNER, MAKE A DECISION REGARDING THE APPLICATION OF THE COLLEGE. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
