                                 BILL NUMBER:  S6345

 TITLE OF BILL :  An act to amend the public health law, in relation
to physician-home care collaboratives supporting primary care, public
health and medical management

 PURPOSE :

This legislation promotes coordinated, cost-effective, primary and
preventive priority, health care through close physician-homecare
agency partnerships.

 SUMMARY OF PROVISIONS :

Section one of the bill amends section 2805-x of the public health law
to add "Physicianhomecare agency collaboratives supporting primary
care, public health and medical management" to the program options
under the Hospital-Homecare-Physician Collaboration program. Prime
examples of services under such physician-homecare partnerships that
could yield major health support to patients as well as opportunities
for cost-effective care, and avoidance of preventable hospitalizations
and other high risk events, are: (i) assistance with effective care
transitions, (ii) in-home follow-ups to physician visits to check
status/progress of the condition or medical intervention, (iii)
in-home evaluation of a homebound or clinically frail patient in lieu
of transport to the physician's office or other out-of-home medical

setting, or for a prompt evaluation to avert deterioration or injury,
and/or (iv) a home environmental assessment to evaluate for and/or
mitigate medical risks associated with asthma, falls, or other patient
health factors, (v) provision of population health services including
but not limited to immunization, public health screening or medication
review.

Section 2805-x provides authority for regulatory flexibility and
streamlining for collaboratives, upon request to and approval of the
state commissioner of health, in order to facilitate the goals of the
collaborative - in this case, the provision of primary care, public
health and medical management - and the public health of the state's
citizens.

Section two of the bill provides an effective date.

 JUSTIFICATION :

This legislation would promote coordinated, cost-effective, primary
and preventive priority health care through close physician-homecare
agency partnerships, and through these models increase access to care
and patient-centered capability of the system. This legislation is
consistent with the major trends and directions in the health system
as well as the trends in demographics and overwhelming
consumer-preferences.

 AN ACT to amend the public health law,  in  relation  to  physician-home
   care collaboratives supporting primary care, public health and medical
   management

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph (a) of subdivision 4 of  section  2805-x  of  the
 public health law, as added by section 48 of part B of chapter 57 of the
 laws of 2015, is amended to read as follows:
   (a)  Hospital-home  care-physician  integration initiatives, including
 but not limited to:
   (i) transitions in care initiatives  to  help  effectively  transition
 patients  to  post-acute  care  at  home,  coordinate follow-up care and
 address issues critical to care plan success and readmission avoidance;
   (ii) clinical pathways for  specified  conditions,  guiding  patients'
 progress and outcome goals, as well as effective health services use;
   (iii)  application  of  telehealth/telemedicine services in monitoring
 and managing patient  conditions,  and  promoting  self-care/management,
 improved outcomes and effective services use;
   (iv)  PHYSICIAN-HOME  CARE  AGENCY  COLLABORATIVES  SUPPORTING PRIMARY
 CARE, PUBLIC HEALTH AND MEDICAL MANAGEMENT;
   (V) facilitation of physician house calls to homebound patients and/or
 to patients for whom such  home  visits  are  determined  necessary  and
 effective for patient care management;
   [(v)]  (VI)  additional  models  for  prevention of avoidable hospital
 readmissions and emergency room visits;
   [(vi)] (VII) health home development;
   [(vii)] (VIII) development and demonstration of new  models  of  inte-
 grated  or collaborative care and care management not otherwise achieva-
 ble through existing models; and

  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   [(viii)] (IX) bundled payment demonstrations  for  hospital-to-post-a-
 cute-care  for  specified  conditions  or  categories  of conditions, in
 particular, conditions predisposed to high  prevalence  of  readmission,
 including  those  currently  subject to federal/state penalty, and other
 discharges with extensive post-acute needs;
   § 2. This act shall take effect immediately.
