 Introduced  by  Sens. KENNEDY, BOYLE, COMRIE, HAMILTON -- read twice and
   ordered printed, and when printed to be committed to the Committee  on
   Investigations and Government Operations
 
 AN ACT to amend the alcoholic beverage control law, in relation to keep-
   ing drinks containing alcoholic beverages in kegs

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph (b) of subdivision 2 of section 106 of the  alco-
 holic beverage control law, as added by chapter 512 of the laws of 2000,
 is amended to read as follows:
   (b)  Notwithstanding  the provisions of paragraph (a) of this subdivi-
 sion, a retail licensee for on-premises consumption may prepare and keep
 drinks containing alcoholic beverages in  dispensing  machines,  [having
 capacities of not less than a gallon, which continually mix such drinks]
 KEGS,  SELTZER BOTTLES, OR OTHER CONTAINERS.  THE STATE LIQUOR AUTHORITY
 SHALL PROMULGATE RULES AND REGULATIONS REGARDING THE SIZE  AND  TYPE  OF
 CONTAINERS FOR USE UNDER THIS SECTION.
   § 2. This act shall take effect immediately.
