                                 BILL NUMBER:  S6705

 TITLE OF BILL :  An act to amend the public health law, in relation
to emergency and non-emergency transportation of medical assistance
recipients

 PURPOSE :

Requires Medicaid reimbursed emergency or non-emergency medical
transportation be conducted by entities that either own or lease their
vehicles, and that such transportation may not be delegated or
subcontracted to third parties.

 SUMMARY OF PROVISIONS :

Section 1 of this bill amends Public Health Law to add a new section
of law, § 3005-c, clarifying the definitions of "emergency medical
transportation" and "non-emergency medical transportation."
Additionally, it requires that entities that provide emergency medical
or non-emergency medical transportation of Medicaid recipients must
own and operate their own vehicles. It further prohibits these
entities from subcontracting or delegating to third parties. In
accordance with existing rules and regulations, vehicles employed for
these types of transportation must be maintained and inspected.

 JUSTIFICATION :

Entities providing non-emergency transportation for Medicaid
recipients currently fall under a patchwork of statutes, rules and
regulations. While many providers adhere to these laws and regulations
and provide quality services, some providers engage in sub-contracting
with other transportation entities who operate on the fringes of what
is technically permitted. In doing so, these entities are jeopardizing
the health safety of the individuals whom they serve. The provisions
of this bill will enhance both public and patient safety by ensuring
that these Medicaid reimbursed transports are only performed by
entities who are covered by departmental rules and regulations.

Further, the bill would prohibit these entities from subcontracting to
other non-compliant entities, and require that all vehicles be subject
to maintenance and inspection requirements promulgated by the
commissioner. These provisions will ensure that all vehicles used for
medical transport will be subject to the requirements of this section,
and will guarantee that all vehicles will be properly inspected and
maintained while delivering services and transporting patients.

 AN ACT to amend the public health law,  in  relation  to  emergency  and
   non-emergency transportation of medical assistance recipients
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 3005-c to read as follows:
   § 3005-C. EMERGENCY   AND   NON-EMERGENCY  TRANSPORTATION  OF  MEDICAL
 ASSISTANCE RECIPIENTS. 1. FOR PURPOSES OF  THIS  SECTION  THE  FOLLOWING
 TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   (A)  "EMERGENCY  MEDICAL TRANSPORTATION" SHALL MEAN TRANSPORTATION FOR
 THE PURPOSE OF OBTAINING HOSPITAL  SERVICES  FOR  A  MEDICAL  ASSISTANCE
 RECIPIENT WHO SUFFERS FROM SEVERE, LIFE-THREATENING OR POTENTIALLY DISA-
 BLING  CONDITIONS  WHICH REQUIRES EMERGENCY MEDICAL SERVICES, AS DEFINED
 IN SUBDIVISION ONE OF SECTION THREE THOUSAND ONE OF THIS ARTICLE,  WHILE
 THE RECIPIENT IS BEING TRANSPORTED.
   (B)  "NON-EMERGENCY  MEDICAL TRANSPORTATION" SHALL MEAN TRANSPORTATION
 FOR THE PURPOSE OF OBTAINING NECESSARY MEDICAL CARE  OR  SERVICES  TO  A
 MEDICAL ASSISTANCE RECIPIENT.
   2.  ANY  EMERGENCY  MEDICAL  TRANSPORTATION  OR  NON-EMERGENCY MEDICAL
 TRANSPORTATION OF A MEDICAL ASSISTANCE RECIPIENT SHALL BE PROVIDED BY AN
 INDIVIDUAL, PARTNERSHIP, ASSOCIATION, CORPORATION, MUNICIPALITY  OR  ANY
 LEGAL  PUBLIC  ENTITY  OR SUBDIVISION THEREOF BY MEANS OF TRANSPORTATION
 VEHICLES THAT ARE DIRECTLY OWNED OR LEASED BY SAID INDIVIDUAL,  PARTNER-
 SHIP,  ASSOCIATION, CORPORATION, MUNICIPALITY OR ANY LEGAL PUBLIC ENTITY
 OR SUBDIVISION THEREOF, AND SUCH TRANSPORTATION  MAY  NOT  BE  ASSIGNED,
 DELEGATED,  OR  SUBCONTRACTED  TO  THIRD  PARTIES. SUCH VEHICLES MUST BE
 MAINTAINED AND INSPECTED IN ACCORDANCE WITH  RULES  PROMULGATED  BY  THE
 COMMISSIONER.
   § 2. This act shall take effect immediately.

 LEGAL PUBLIC ENTITY OR SUBDIVISION THEREOF BY  MEANS  OF  TRANSPORTATION
 VEHICLES  THAT ARE DIRECTLY OWNED OR LEASED BY SAID INDIVIDUAL, PARTNER-
 SHIP, ASSOCIATION, CORPORATION, MUNICIPALITY OR ANY LEGAL PUBLIC  ENTITY
 OR  SUBDIVISION  THEREOF.  WITH  THE EXCEPTION OF MUNICIPAL FIRE DEPART-
 MENTS, SUCH TRANSPORTATION MAY NOT BE ASSIGNED,  DELEGATED,  OR  SUBCON-
 TRACTED  TO  THIRD  PARTIES.  SUCH  VEHICLES  SHALL  BE  MAINTAINED  AND
 INSPECTED IN ACCORDANCE WITH RULES PROMULGATED BY THE COMMISSIONER.
   § 2. This act shall take effect immediately.
