AN ACT to amend the education law, in relation to requiring persons
applying for a certificate or license to be a teacher to receive a
passing score on the academic literacy skills test and the teacher
performance assessment
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 3004 of the education law is amended by adding a
new subdivision 1-b to read as follows:
1-B. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COMMISSIONER
SHALL REQUIRE ALL PERSONS APPLYING, ON OR AFTER JANUARY FIRST, TWO THOU-
SAND EIGHTEEN, FOR A CERTIFICATE OR LICENSE TO BE A TEACHER, IN ADDITION
TO ALL THE OTHER CERTIFICATION OR LICENSURE REQUIREMENTS, TO RECEIVE A
PASSING SCORE ON THE ACADEMIC LITERACY SKILLS TEST AND THE TEACHER
PERFORMANCE ASSESSMENT. THE COMMISSIONER SHALL NOT PROVIDE A MULTIPLE
MEASURES REVIEW PROCESS, ANY EQUIVALENCY MEASURES OR ANY SAFETY NET
MEASURES IN LIEU OF SECURING A PASSING SCORE ON THE ACADEMIC LITERACY
SKILLS TEST OR THE TEACHER PERFORMANCE ASSESSMENT.
§ 2. Any regulation providing a multiple measures review process, any
equivalency measures, or any safety net measures for applicants who fail
to achieve a passing score on the academic literacy skills test or the
teacher performance assessment are null and void.
§ 3. This act shall take effect immediately; provided, however, that
section one of this act shall be deemed to have been in full force and
effect on or after March 13, 2017.
