 Introduced  by  Sen.  AVELLA -- read twice and ordered printed, and when
   printed to be committed to the Committee on Veterans, Homeland Securi-
   ty and Military Affairs
 
 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation  to  an  exemption  for  veterans' service organizations from
   certain fees

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  24-255 of the administrative code of the city of
 New York is amended by adding a new subdivision (c) to read as follows:
   (C) 1. FOR PURPOSES OF THIS SUBDIVISION "VETERANS'  SERVICE  ORGANIZA-
 TION"  MEANS  AN ASSOCIATION, CORPORATION OR OTHER ENTITY THAT QUALIFIES
 UNDER SECTION 501(C)(3) OR SECTION 501(C)(19) OF  THE  INTERNAL  REVENUE
 CODE  AS A TAX-EXEMPT ORGANIZATION THAT HAS BEEN ORGANIZED FOR THE BENE-
 FIT OF VETERANS  AND  RECOGNIZED  OR  CHARTERED  BY  THE  UNITED  STATES
 CONGRESS,  INCLUDING, BUT NOT LIMITED TO THE DISABLED AMERICAN VETERANS,
 THE VETERANS OF FOREIGN WARS, THE AMERICAN LEGION AND THE VIETNAM VETER-
 ANS OF AMERICA. THE TERM ALSO INCLUDES A MEMBER OR EMPLOYEE OF AN ELIGI-
 BLE NON-PROFIT VETERANS' CORPORATION, ASSOCIATION OR ENTITY, SUCH AS THE
 MISSING IN AMERICA VETERAN RECOVERY PROGRAM, THAT  SPECIFICALLY  ASSISTS
 IN  FACILITATING  THE IDENTIFICATION AND INTERNMENT OF UNCLAIMED REMAINS
 OF AMERICAN VETERANS.
   2. A VETERANS' SERVICES ORGANIZATION SHALL  BE  EXEMPT  FROM  ANY  FEE
 LEVIED BY THIS SECTION.
   § 2. Subdivision 6 of section 25-202 of the administrative code of the
 city  of  New York, as amended by local law number 46 of the city of New
 York for the year 2011, is amended to read as follows:
   6. Exemptions. (A) The provisions of this section shall not apply if a
 municipal department or agency of the city is the applicant or appellant
 before the board of standards and appeals.
   (B) 1.  FOR PURPOSES OF THIS SUBDIVISION "VETERANS' SERVICE  ORGANIZA-
 TION"  MEANS  AN ASSOCIATION, CORPORATION OR OTHER ENTITY THAT QUALIFIES
 UNDER SECTION 501(C)(3) OR SECTION 501(C)(19) OF  THE  INTERNAL  REVENUE
 CODE  AS A TAX-EXEMPT ORGANIZATION THAT HAS BEEN ORGANIZED FOR THE BENE-
