TITLE OF BILL:  An act in relation to authorizing Paul Nehrich to be
considered a "veteran" for real property taxation purposes

 
PURPOSE:

To grant Mr. Paul Nehrich the Alternative Veterans Exemption under
Section 458-a of the Real Property Tax Law of New York State by defining
him as a "veteran" under Section 458-a(1)(c)and(e).

 
SUMMARY OF PROVISIONS:

Section One defines Mr. Paul Nehrich, of Freeport, NY, as a "veteran"
under Section 458-a(1)(e) of the Real Property Tax Law of New York State
such that he is considered a "qualified owner" under 458-a(1)(c). This
designation allows Mr. Nehrich to obtain the Alternative Veterans
Exemption for property taxes on his property in Freeport, NY.

Section Two is the effective date.
              

 
JUSTIFICATION:

Mr. Nehrich served our country in the Army National Guard in the early
1960s. During his service, Mr. Nehrich accrued five months and twenty-
nine days of active service time according to his DD214 form.  Mr.
Nehrich also served an additional four months and three days through
two-week long summer camps and one weekend per month for three years.
Further, from 1975-2010, the Nassau County Assessor granted Mr. Nehrich
the Alternative Veterans Exemption for property taxes on a qualifying
property he owned in Bayville, NY. After selling his property in
Bayville, and buying a property in Freeport, NY, Mr. Nehrich again
applied for the exemption, but was denied because the County Assessor
found that he had served less than six months and did not qualify as a
"veteran" under the Real Property Tax Law of New York State. Since 2011,
Mr. Nehrich has appealed this decision, but has yet to be granted a
hearing. Due to the hardship that the denial of the exempt status poses
to Mr. Nehrich, which he had received for thirty-five years prior to the
County Assessor's denial, this legislation would grant Mr. Nehrich a
designation as a "veteran" for the purpose of allowing him to receive
the Alternative Veterans Exemption under Section 458-a of the Re al
Property Tax Law of New York State.
