AN ACT to amend chapter 259 of the laws of 1966 establishing in and
constituting as a separate union free school district certain territo-
ry in the town of Mount Pleasant in the county of Westchester, and to
amend chapter 628 of the laws of 2004 providing for the composition of
boards of education of special act school districts, in relation to
the composition of the union free school district number four of the
town of Mount Pleasant, in the county of Westchester (Pleasantville
Cottage School)
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 2 of chapter 259 of the laws of 1966 establishing
in and constituting as a separate union free school district certain
territory in the town of Mount Pleasant in the county of Westchester is
amended to read as follows:
§ 2. The said district shall be under the control of a board of educa-
tion, which shall be composed of [from five to nine] SEVEN members OF
WHICH THREE MEMBERS SHALL BE elected by the board of trustees of the
Jewish Child Care Association of New York, as constituted pursuant to
the provisions and by-laws therein provided by the membership corpo-
rations law, said members to serve for terms not exceeding five years;
TWO PUBLIC MEMBERS SHALL BE APPOINTED BY THE COMMISSIONER OF EDUCATION;
AND TWO PUBLIC MEMBERS, EACH A RESIDENT OF THE VILLAGE OF PLEASANTVILLE,
WITH ONE SUCH MEMBER APPOINTED BY THE MAYOR OF SUCH VILLAGE AND THE
OTHER SUCH MEMBER APPOINTED BY THE TOWN SUPERVISOR OF THE TOWN OF MOUNT
PLEASANT; and such board shall have all the powers and duties of a board
of education of a union free school district under the provisions of the
education law. ALL PUBLIC MEMBERS OF THE BOARD OF EDUCATION SHALL SERVE
TERMS OF FOUR YEARS.
§ 2. Section 2 of chapter 628 of the laws of 2004 providing for the
composition of boards of education of special act school districts, as
amended by chapter 629 of the laws of 2004, is amended to read as
follows:

§ 2. (A) Notwithstanding any provision of law to the contrary AND
EXCEPT AS PROVIDED OTHERWISE IN SUBDIVISION (B) OF THIS SECTION, the
board of education of every school district enumerated in section 1 of
chapter 566 of the laws of 1967, as amended, shall also include two
public members each serving a term of four years, which term may be
changed pursuant to the education law. The public members shall neither
be employed by nor members of the board of trustees of the child care
agency designated in such chapter to appoint the non-public members.
Pursuant to regulations promulgated by the commissioner of education,
the public members shall be appointed by the commissioner of education
from a list of potential candidates who submit a letter of intent to the
state education department.
(B) NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION (A) OF THIS SECTION,
THE BOARD OF EDUCATION OF THE UNION FREE SCHOOL DISTRICT NUMBER FOUR OF
THE TOWN OF MOUNT PLEASANT, IN THE COUNTY OF WESTCHESTER, (PLEASANTVILLE
COTTAGE SCHOOL) SHALL BE COMPOSED OF SEVEN MEMBERS OF WHICH FOUR SHALL
BE PUBLIC MEMBERS, EACH SERVING A TERM OF FOUR YEARS. TWO SUCH PUBLIC
MEMBERS SHALL BE APPOINTED BY THE COMMISSIONER OF EDUCATION, AND THE
REMAINING TWO SUCH PUBLIC MEMBERS SHALL BE RESIDENTS OF THE VILLAGE OF
PLEASANTVILLE, WITH ONE BEING APPOINTED BY THE MAYOR OF SUCH VILLAGE AND
THE OTHER BEING APPOINTED BY THE TOWN SUPERVISOR OF THE TOWN OF MOUNT
PLEASANT. THE PUBLIC MEMBERS SHALL NEITHER BE EMPLOYED BY NOR MEMBERS OF
THE BOARD OF TRUSTEES OF THE ASSOCIATION OPERATING SUCH SCHOOL DISTRICT
PURSUANT TO CHAPTER 259 OF THE LAWS OF 1966, AS AMENDED.
§ 3. This act shall take effect on the first of January next succeed-
ing the date on which it shall have become a law.
